Hi everyone,
Current status tier 4 dependent till March 2021
Wife Tier 4 till March 2021
Daughter 2 years old tier 4 dependent till March 2021
I am about to apply ilr LR next month.
If i don't get any decision unitl March what visa should i apply for my wife and daughter?
Can i apply spouse for wife and include cover letter explaining the situation but what will happen to my daughter will she become overstayer?
. TIA

What basis are you applying ILR? Long Residence?
Is your daughter born in UK??
What is your wife’s immigration history?
What is your immigration history?

Your history says you are applying via LR. Your wife will have to switch to FLR(M) eventually to settle in UK before her Tier 4 expires or apply via LR also if she qualifies earlier. If she has to switch to FLR(M), her ILR clock will be new 5 years on FLR(M).
Assuming your daughter is born in UK.
If your daughter is born in UK, you can simply register her as British Citizen after you get ILR. Your daughter’s visa expiry is irrelevant in this case.

She can switch to FLR(M) when you apply your ILR via LR yes. Her visa will only be granted after your ILR is granted first.
OR she can simply wait till you get your ILR first as long she has valid leave to remain. She must switch before her current visa expiry though.

Hi again,
One more question regarding my ilr long residence application.
My tier 4 visa was curtailed in Jan 2012 and i applied for extention in nov 2012 which was granted in Nov 2013.
I never received a curtailment letter and the curtailment letter was sent to college old address and letter returned to home office as undelivered (All this info is on my Subject access request)
Can prove college moved to new address from companies House record.
Now when i apply for Ilr Long Residence will this be a problem? Or shall i write a cover letter to explain that i was unaware of curtailment as don't want to get refusal and go to court as this will cost me alot.
TIA
