Need your guidance on my wife’s and kid’s ILR.

My wife was on Tier2 ICT PBS Dependent since 2012 visa till 2017 (visa end date 6th Sep 2017). ( total 5 years)

We Left the UK on 04th Sep and applied to switch Tier1 ET and PBS dependent visa( for my wife and kid) (all together) from India. ( absence 5 months only)

We all got BRP vignette (Dec - 2017 - Jan 2018)
We all arrived to UK on Jan 2017- as per our BRP date. No issues there.

I’m due to apply for ILR via ET 3 year route.
Guidance I need is that can I apply for my wife and Son’s ILR with me as dependents with me on this route as they have been with me as dependents for more than 5 years ( 5 years in ICT and 3 years in ET)

Please guide.

Hi Thank you for your reply.
However, the situation is similar but the post doesnot give me the concrete answer for my question on my dependents ILR? So prompted me to ask.

Also, I'm not the same person but in similar situation.

Looking forward for all the guidance that I can get here.

If user @tier2g can also reply that will be great.

What date did you apply for the visa in India?

If an applicant’s leave expires whilst they are outside the UK and they apply for new entry clearance more than 14 days after their previous leave expires, for any reason, the continuous period is broken and leave is not aggregated. The continuous period would also be broken where the gap is within 14 days, but you do not consider the reasons provided to be sufficiently compelling.
