ILR for Dependant - query on How long you have lived in UK

Hello,

I am Balachandran, i am a British citizen from 2015 January. My Wife and Daughter who are applying for ILR, currently i am filling the form for them. And i came across the "How long you have lived in UK ?" question.

My Wife and Daughter's first Entry as HSMP Dependent during 2008 & 2009 respectively.

But due to my Daughter's health issue their stays are outside of UK for Long compared to their stay in UK. And when they were as Tier 1 Dependant, their Visa expired when they were outside UK.

Then in October 2013, they came through Spose visa (Entry clearance) again. And during that visa period as well there is 1 year break.

But from OCT 2015 to till date, we have settled togather in UK (So 5 years 2 months as of now).
They are with their second FLR M visa period (expires on Nov 2021). But as they are already eligible for ILR with 5 years stay.

I am going for their ILR visa now.

There was a dilema, as i ready information like, to apply only when there is 28 days from current visa period.
(I think this applies for persons coming with any break in 5 year route).

Second, to answer the below question,

"How long you have lived in UK ?"

should i consider all of their stay from 2008 & 2009 or only from Spouse Visa (Oct 2013).

Please provide your thought and advice on this.

Hi All,

Currently i am filling ILR form for my Wife and Daughter. They have a History of breaks and stayed outside UK from 2008 First Entry clearance as HSMP Dependant due to my daughter's health issue, finally from Oct 2 2015 onwards, we are able to settle in UK and have crossed now 5 yrs 2 months without any long breaks.

Date of First Entry to UK : 08 June 2008

Visa Type: VISA HSMP PARTNER: 08 MAY 2008 - 07 JAN 2010
(Visa Period : 1 yr 8 Months)

- Had 7 months break

Visa Type: TIER 1 (Dependent) Partner: 15 JAN 2010 – 15 JAN 2013
(Visa Period : 3 yrs)

- stayed in 7 months and 2.5 yrs outside in the visa period
- And visa expired, when they were outside

Then entered UK again in Spouse visa

Visa Type: VISA SPOUSE/CP – Spouse/CP of B KULANTHAIVEL: 09 OCT 2013 - 09 JUL 2016
Visa Period : 2 Years 9 Months

VAF4A Entry Clearance (Entered UK on): 20 Oct 2013

- Had 1.1 yr break
- Had a 4.5 months break
- so 1.5 yrs outside and 1.4 yrs inside

( With in the Visa Period from Oct 2 2015, where able to settle with out long breaks)

FLR M First Extension :

Visa Type : SPOUSE/PARTNER Leave to Remain : 20 Jun 2016 - 05 Jan 2019
Visa Period : 2 Years 6 Months 16 Days

3 Family visits between 30 - 40 days each.

Second FLR M Extension :

Visa Type: SPOUSE/PARTNER Leave to Remain : 18 Feb 2019 - 30 Aug 2021
Visa Period : ~ 2 Years 6 Months 11 Days

1 Family visit outside UK for 20 days

As of OCT 2 2020, have crossed 5 Yrs without long breaks.

And as of today 21/12/2020 - 5 yrs 2.5 months from OCt 2 2015.

So now for the ILR question,

How long have you lived in the UK ?

Should i calculate (inside) UK days from Jun 2008 or from Spouse visa Entry clearance (20 OCT 2013)

And listing all absents from start living in the UK ?

Again calculation from Jun 2008 or from the Spouse visa entry (20 OCT 2013).

Please provide your comments.
