ILR Tax code query

Dear members, I am looking to apply for ILR in Tier2 general 5yrs route. I had underpayment tax for 2017-18 & 2018-19 due to tax code missed to be changed by HMRC while I got removed from self-assessment list. However got everything cleared last year. Can someone please let me know if I should mention this in my application as my P60's are not showing the full tax paid. Employment letter received from HMRC also shows same P60 pay and tax values.

Can someone please let me know when am I eligible to submit the ILR applications?
Is it mandatory that one should have been in UK the same date 5 years back?
What is the best date for both applications together?

Self -Tier 2 general
Visa Issue Date: 10 Feb 2016
UK Arrival Date: 20 Feb 2016
Visa End Date: 04 Mar 2021

Note: I had visited UK on an official trip in 2010 for 2 weeks.

Partner - Tier 2 general dependant
Visa Issue Date: 01 Mar 2016
UK Arrival Date: 30 Mar 2016
Visa End Date: 04 Mar 2021

Topics merged. Please do not post ILR questions in the tier 2 sub forum. Keep all questions on ilr in one topic, this one

1. No. The physically present in the UK 5 years ago requirment is for citizenship, NOT for ILR

2. 1 march 2021 minus 28 days.

Your visit in 2010 is completely irrelevant to ilr based on 5 years residence

When did you first enter UK?
Can someone please let me know....should I mention the date first I came to UK in 2010 by business visa or the date I came in 2016 by tier 2 general work visa?

Many Thanks in Advance!

@zimba @srsw & Team,

Before applying for ILR, I kindly request your expertise suggestion on my tax code issue explained in detail. Appreciate if someone can please look into my query below and respond.

For Tax year 2015-16, I had basic tax code due to no NI number received so paid more tax. I submitted self assessment by 2016 year end with help of auditor and got the refund. Tax code was right for 2016-17 assessment year but don't know why again it was changed to basic rate in April 2017. I requested HMRC to remove me from self assessment in August 2017 and got removed but unfortunately my tax code was left in basic rate and not changed until I called HMRC in March 2019. I wasn't aware of this code system much. I then requested tax review for old years and got Pa302 detailing the tax underpayment for 2017-18 & 2018-19 for £3500 in total. I got it cleared by Sep 2019. I am due to apply for ILR soon. Will this create any issue with my ILR? Should I explain this in a letter?

This should not create any issue as you cleared the underpayments and therefore your tax affairs are in order.
You may ref it in letter for peace of mind.
PS what of 2019-2020?

Council Tax Discount Query

Dear Team,
I recently got the letter from Council as a proof of living for my spouse and myself as a cohabitation proof. It was mentioned as we both started living since 1st Mar 2016 but my wife first came to UK on 30th March 2016 so I requested a correction on the date for my wife. Now I see in online they have revised 2015-16 bill with discount as single occupancy for 29days. I never asked for it but they have created such bill and yet to receive it. Please can someone tell me Will this create any issue for our ILR? My wife entry clearance was given on 15th March 2016 while in BRP its 1st Mar 2016.

You need to prove cohabitation proof only for last 2 years from the date of application. This is irrelevant to your ILR that too from 2016.

Many Thanks for your quick reply. I am worried if this discount will show as using public funds in my record.
