ILR Unpaid paye!

Hi,

this forum help us get though our previous extensions,

need advise this is our first post.

Our Tier extension was granted on second application and there was around 18 Months of delay due to interviews and office visit.

during this time i was not allowed to work so i have taken myself off from payroll.

our all and current period was good no issues in company affaires. but the period of 18 months when i was not allowed to work . there is unpaid paye tax which is still pending . now due to covid company nor my self in position to pay.

above 18 months of second application was really stressful as no income for me and we kept employee to run the day to day work.

when i got extension i received one letter for paying amount from debt company which i am paying in instalment and still paying as paying agreement.

but there is another amount which they did not follow up since i take over the office, i ask the debt company give me full pending amount but they give me figure which i believe not correct amount must be more than that.

in those 18 months period i did not claim employment point nor used any documents for immigration purpose.

Please also note that i convey them the message though my MP that living with 4 kids we are feeling financial hardship.

i know ILR though O will be difficult does ILR LR also will be difficult for us.

some where i read its civil matter,

also let me clarify there is no CJ on company name. company accounts and other affairs are intact

Looks like you are on a Tier 1 Entrepreneur visa? Why were you not allowed to work? Your work rights remain the same as long you made an in time application protected by Section 3C.

it was second application, first was rejected on some point which i clarify on second application.

First of all please state full circumstances of your immigration history with dates. Also “number” your questions (1) (2) (3) etc so its easier to understand and answer properly.

First Extension Application 08/03/2019
Refused 03/02/2019
AR 13/02/2019

Second Extension Application 28/02/2019
office interview 09/01/2019
Granted 10/11/2020

so period from 28/02/2019 to 10/11/2020 no 3C

i dont know how to put it in 1/2/3

please read my history see is there will be issue of unpaid paye as this was beyond my control and still me and my company struggling financially

there is no CJ on company name, and paying part of bill to debt company.

There are specific requirements you have to meet for ILR. You must meet them to qualify for ILR.

PAYE for whom? Your tax affairs should be accurate when you apply for ILR.

Also, note even if you apply via LR, although Tier 1 Ent documents will not be needed but HO may make all their own checks that you have complied with the rules and your tax affairs are accurate. Expect more scrutiny also.

Yes this is for ILR through 5 years route. i don't think there is any such requirement for LR as this is HR application. i also believe if i am not wrong this comes in GC which is BC requirement.

my question does it comes in deception?

i did not claim point for this period, nor i used for gaining immigration status
