IHS refund after qualifying under 10 years residence whilst waiting for appeal

Hello everyone!

This is my first post and I have seen some interesting cases and advise. I was wondering if I can be assisted.

I applied for FLR via family life in Sep 2019. This was refused in February 2020. I was given an appeal date in April 2021. I however accumulated 10 years lawful residence in November 2020 (whilst awaiting the appeal) meaning that I now qualified for leave under 276B. At the hearing, my barrister presented further submissions and HO agreed to issue ILR.

My two questions are:
1. Am I entitled to a refund of the IHS?
2. If not, can I claim a refund via the COVID-19 scheme as I am an NHS worker?

Unlikely.
Pay for UK healthcare as part of your immigration application - Refunds wrote:You will not get a refund if:
  • your visa application is successful but you do not come to the UK
  • you leave the UK before your visa ends, for example to make a new application
  • you’re told to leave the UK before your visa expires
  • you’re applying for indefinite leave to remain

Most likely yes, but conditions apply.
