Main applicant ILR and dependent children

Hi,

I qualify for ILR under the 5 year route (Tier 2 General)

I have two pbs dependent children who joined me in the UK 2 years ago. One child has since turned 18. I have sole custody of both children.

1) Do PBS dependent children need 5 years residents to qualify for ILR?
2) Would the under 18 child qualify for ILR with me since I have sole custody?
2) For the child over 18, does she apply to extend under pbs or does she also qualify for ILR with me?

Many thanks

If you have sole responsibility, then both children may qualify for ILR with you.

Thank you for your reply.

I do have sole responsibility of both children and court ordered custody.

Sole responsibility is not the same as sole custody. It has a more comprehensive definition
