Skilled worker visa -> ILR ( new grounds for refusal )

Hi,

I came across the revised guidance with regards to grounds for refusal based on past offenses/convictions/criminal records.

Has anyone successfully applied for ILR recently with past driving convictions resulting in non-custodial sentences? I am looking at applying at applying for ILR sometime later this year and I have a drink driving offense from about 8.5 years ago committed overseas.

Earlier the guidance was better defined with mandatory refusals for any non-custodial sentences in the last 24 months from the date of application. The new guidance makes it look highly discretionary now.

Also if possible can someone help understand what impact this new guidance will have on my ILR application? Its a 8.5 yr old offense and was declared twice previously for Tier 2 related applications as well.

You are overthinking this. Convictions from overseas from 8.5 years ago will have no effect on your ILR
