Hi all,
Hope you all are doing good.
I will be eligible to apply ILR next month.
I have few questions regarding my spouse visa.
She is going to complete 5 years in august 2021. But her BRP expiry is on 17 July 2021 same like mine.

1) do I need to apply her extension visa as she will be eligible after month when her BRP is expiring
2) can I apply her ILR too with mine?
3) if I have to go with her extension visa then which BRP details I have to enter as I might in process of ILR?
4) if she got appointment after 17 July 2021 will that be fine as she might need to wait for my ILR details In her application?

Can someone please assist with this?

TIA

She can apply for ILR 28 days before completing her 5 years. For ILR, only the date of the decision matters which means you can apply early and attend the appointment on a date that is within that 28 days period or later. You can apply together for ILR using form SET(O) and there is no need for an extension.

Thanks Zimba for reply.
Her decision was made on 26/8/2016 that means she can apply for her ILR (26/8/2016 - 28days=) on 30/7/2021
But her BRP going to expire on 17/7/2021
That’s almost 13 days gap. Will that be fine.

CR001 sorry but I don't understand what you trying to say. She about to complete her 5 years tier 2 depndent visa in 30/7/2021 but her BRP going to expire on 17/7/2021. And I'm going to apply for my ILR next month as My tier 2 general visa also going to expire in 17/7/2021, so she can apply with me or not?

The 'date of decision' I referred to above is the date which UKVI caseworker decides to process and grant her ILR after the biometrics.

You can apply early and as long she is eligible for ILR on the 'date of decision', her ILR will be granted. So you both apply together before 17/7/2021 and book an appointment for 30/7/2021 or later. This way the The 'date of decision' will be on or after 30/7/2021

Regarding degree certificate spelling mistake and Uk born baby citizenship

Hi All
Hope you all doing good.
I need some expert advice in ILR process.
1) My wife’s spelling got printed wrongly on her master degree certificate. I printed as Sreedevi instead of Sridevi. All her other documents are spelled Sridevi like passport, brp.
We obtained her NARIC certificate at the time of tier 2 visa process in 2016. Which also has Sridevi.
Can this be going to affect for ILR process as we need to submit NARIC and degree certificate both.

If anyone came across this kind of situation then Please kindly advice.

2) does anyone knows the process of applying for British citizenship for child born in UK and has Indian passport

TIA

1. If the spelling is correct on NARIC I do not see an issue.
2. After one parent gets ILR, the child can be registered as British using form MN1

Thanks Zimba for quick reply.
As we need both NARIC and degree certificate to upload for ILR. So that gonna make any difference?
I have government notary document too for spelling mistake which we obtained in 2016 back in India.
Should I upload that too for safer side.
