ILR Application

Hi Members,
I’m applying for my wife’s ILR and I got couple of questions to get clarified.
1. My wife’s first entry to the UK was 12th Sept 2016 and she has finished her five years this sept 2021. Her visa doesn’t run out until December 2021. Can she apply now as she’s already stayed in the UK for five years or wait for 28days before visa expires?
2. I’ll be providing my bank statements for her application, should I be showing £3k minimum maintenance funds in my account for three months? Not sure if this requirement should be met.

Useful to state what visa category she holds and the date the initial visa was stamped in her passport.
Also useful to state your immigration Status and if you got ILR, through which route.
Different visa routes have different rules and requirements.

She’ll be applying for ILR Set (M) 5yr route.
I hold a British passport (ILR ten yr route).

She could have applied for ilr within 28 days before 12 september 2021 if she has held a spouse if ILR holder or British citizen for 5 years (IE not held OBS dependent and switched to FLR M less than 5 years ago)
Presumably she therefore received a spouse visa abroad after you already held ILR etc.

That’s right. She came in as dependant while I was on ILR in 2016 and extended leave to remain in 2019. Good that she is eligible now to apply. Which I’m going to do soon. Another thing I ain’t sure about is maintaining min balance of £3k for three months. Is this a requirement?

There is NO such requirement and there never has been either.
You have to prove you meet the £18,600pa financial requirement, as you did initially and for the extension 2.5 years ago.
