Tier 2 to ILR 5 years time calculation problem

Hey all,

I originally switched from tier 4 to tier 2 and now applying for extension, I was just wondering to calculate the time I can expect to apply for ILR.

My Tier 4 expired on 22nd January 2019 and my company applied for my tier 2 just 4 days before expiry date.

Then I finally received my tier 2 on 3rd April 2019, with expiry date of 17th January 2022, which is now that I am currently applying for extension.

My question is, When is the date that I start the counting of 5 years? Is it
1. the date the brp was issued? ( 3rd April 2019 )
2. the date my tier 4 expired? ( 22nd January 2019 )
3. the expiry date of my current tier 2 minus 3 years? ( 17th January 2019 )

Hello all,

I might've touched base on my question previously but I just wanted a bit more clarification as I went to dig out the old files when the visa was granted.

Tier 4 visa expiry : 21-01-2019
Tier 2 application date : 20-01-2019
Tier 2 visa granted date : 14-03-2019

HOWEVER there was a mistake on the BRP card, my country was wrongly stated, we wrote back to rectify the mistake and received new BRP card Issue date : 03-04-2019

Now I have successfully applied for tier 2 extension which is valid until 31-01-2025

I think Im pretty clear that I can apply for ILR 28 days before reaching 5 years from the visa granted date.
Im just not sure if I can start counting from the original issue date ( which had an error ) : 14-03-2019
or I'll have to use the date when the issued the correct BRP 03-04-2019?

Your ILR qualifying period starts from the first visa approval date. Often your visa approval date is the same as BRP issue date. Given that a BRP cannot be backdated so it ends up with a later date if there is a correction. That does not change your original visa approval date
