Indefinite Leave to Remain - Dependants

Hi Everyone,

Greetings!

I'm in the UK legally for 10 continuous years (long residence) and will be able to apply for indefinite leave to remain in the next couple of months.

My wife and daughter are currently on PBS dependant visa from Sept 2019 and their leave to remain is valid until September 2024.

Can someone advise on my below questions on the dependants ILR process, please?

1. Would my wife and daughter's current leave expire as soon as I get ILR via long residence route ?

2. Can my wife and daughter stay on their current PBS dependant visa until September 2024
and apply ILR (after completion of 5 years) ?

1. No. Buy they should switch to FLR M visa once you get long residence ILR. This visa has English and financial requirements that must be met. This will reset their time to zero for ilr.

2. No they cannot apply for ilr based on 5 years PBS dependent if you get ilr through 10 years long residence. They can only apply for ilr as PBS dependents if YOU apply for ilr based in 5 years PBS route.
