Hi

Could anyone let me know the docs which we can provide as proof of co habitation while applying for ILR under SET o form.
In our case we have council tax bills .
But the bill is two separate bills for the same addresses one in my name and another in my husbands name .
For some reason council is not issuing a single bill with both our names together.

Please advise.

My husband had changed company under tier 2 general visa.
He had travelled to home country on two occasions for a period of 10 days once and another for two days.
This travel took place during 2018 and 2019 while with the previous employer.
While applying for ILR do we need to provide the absence letter from the previous employer.
We are finding it difficult to get the letter from the previous employer.
Are there any other options for us to provide the evidence other than employer letter.

leave taken in 2018-Expiry of father death certificate available
leave taken in 2019-only two days to visit sick mother

Please let me know other available options.

ANY document can be used. There is no specific documentation. As long as you show you both resided at the same address

If the absences are less than 30 per year, then the letter can be omitted

Thanks for your response. Please clarify the below alone :

For proof of cohabitation should the document be addressed to both of us .
The council tax bills are two separate bills with the same address though.

For the absence letter.
The days are less than 30 days(2018 12 days and 2019-4 days).
Do we have to check the option for providing evidence while filling the application.

The cohabitation docs do not need to have both names, just prove that you both reside at the same address. I told you this above.
The online application will often give you a generic list of documents, you must provide documents required as per rules/guides.

Hi All

We are going to apply for ILR in Dec .
Have few queries on the salary threshold limits.
I am on SOC code 2135 which shows the salary limit as £36,600.
It does appear in the Shortage Occupation list.
My current salary is £36000 only.

I read that we need not meet the salary threshold limits if the SOC code appears in the shortage occupation list.
hence would like to confirm whether i will still be eligible for ILR with £36,000.

Just to confirm his working hours are 37.5.
Going by that if i calculate

36600/39*37.5=£35,192

So should be fine is my assumption.
Could some one confirm.

If on shortage list, the salary must be at least £20,480 per year and at least the going rate for the job (whichever is higher)

In our Salary the minimum salary as per the Go rate will be (36600/39*37.5=35192).
So this should be the salary as this is higher.
Is that correct.

Could someone help me with the below queries in filling up the SET O form for my myself, wife and child.

1)When did you first enter UK?
Will this be the date I got my Tier 2 Visa issued(14/12) or the actual date I physically entered UK(30/12)

2)What evidence will you provide to support the reasons for all absences from the UK and Crown Dependencies?

My total time of absence in UK is 12 days (first travel) and 4 days (2nd Travel).
Can I present my fathers death certificate as a proof for absence.
Do I need to get the absence letter from my employer .I had worked between 2018-2019 and moved to my current employer in 2020.

Wife
Does my wife need to get a similar letter from her previous and current employer.
Her period of absence are 14 days(1st Travel),12 days(2nd Travel) and 24 days (3rd Travel)


3)Evidence of Mr Dhamodarran Kothandaraman' s immigration status in the UK

I assume my BRP should suffice

4)Is the account with a bank or utility company for which you have supplied information and supporting documentation held jointly by you and other people?

I am going to submit my bank account statement and joint utility bills with my wife .Does other people refer to a third person or my wife.

I'll answer what I can
1) As either date makes you eligibile, I will say enter the date of physical entrace.
2) You do not need to justify your absence, as long as the total duration is within the allowable limit (which is clearly the case here). You can often ask your employer to include your absence in their letter, to show that they are aware and happy with of your absence. But if your absence happened before your current employer, they wouldn't be able to include that in the letter. That shouldn't be an issue, as ultimately the UKVI uses your passport entry/exit stamps to check your absence. Similarly for your wife, it will be helpful if she gets a letter from her employer, but it's not a must.
3) Yes

For 4) and 5), I think you should say Yes to 4) (and ask your wife to sign in the family consent form), and No to 5) if you are not receiving financial support from other people (excluding your wife).

Absence letter is not needed for your wife.

Yes you are right and your salary is eligible. I just wanted to point out that even on shortage list there is still a minimum requirement.

In my case the house is in the name of my wife ,so can I choose I live with my family option rather than I own it .
I did give money as a gift at the time of purchase but for some personal reasons the house was purchased in her name .
Not sure whether all this will be looked into for ILR.
