Hope all of you here are safe and well. I have a question regarding the financial requirement for ILR.

I am currently on a TIER 2 GENERAL VISA with SOC CODE - 3545. I extended my TIER 2 GENERAL visa for 3 years on 31 May 2019 and as of 7 April 2022 I will be eligible to apply for my ILR. Coming to the point, when I extended my visa in 2019 the SOC code required me to have a minimum salary of £34,500, however now when I see the current SOC CODE LIST the current going rate for my SOC CODE 3545 is £35,400.

My annual salary has been £35,000 from the time of my extension that is 31 May 2019.

1) I started receiving pension from October 2021 and I contribute £143 toward my pension
2) My take home pay is £2278 per month after paying £143 towards my pension

Kindly let me know if I meet the financial requirements under my SOC code to apply for ILR?

I would also like to know if employee pension is calculated as part of my annual gross salary ?

Only the gross salary matters.

How many hours do you work per week? The published going rate is for 39 hours per week. So if your weekly hours of work are different, the going rate for comparison needs to be converted by 35400 / 39 * weekly hours.

According to my COS my weekly working hours are 37.5 and I get £2277.99 net every month. I am really confused with this. Kindly explain it to me clearly.

I am so sorry, just a quick addition to my above reply.

In my COS it states that I have a 37.5 hour work week for which I get a net salary of £2278 every month or £35000 gross every year.

The financial requirement for my SOC is £35,400 based on a 39 hour work week. Kindly let me know if I am eligible as my hourly rate is seems fine according to my calculations.

Going rate is 35400/39*37.5=34038, your gross salary 35000 is sufficient

Thanks for your time. I understood the math you did, but however I really fail to understand on what basis you are saying I am eligible as the going rate comes down to £34,038 instead of £35,400.
