Hi All,

Please help with the query.
I recently become British citizen, my son is holding Indian passport and he will be completing his 10 year residence in next few days. Should I apply SET LR or British passport for him ?

How old is he?

If he was born abroad, he needs ILR first. He can apply to register as British once he has ILR and the other parent also has ILR.

He doesn't qualify for a British passport because he is not British.

My wife will apply ILR and will be british citizen by next year 2023
To avoid the high ILR cost, can i directly apply British citizen for my son in 2023 after my wife becomes citizen ?

so I mean in 2023, child born outside UK holding India citizen can directly apply for British citizenship when both the parents are UK citizen ?

Your spouse and child can apply for citizenship as soon as they have ILR.

A child born abroad requires ILR first.

Children born outside the UK to non-British parents have NO entitlement to British citizenship. Your child can only be registered as British (via the discretion of the home office) if the child has ILR, one parent is British and the other one is at least settled.

Thanks a lot Zimba and CR001. Now my both dependents (Spouse and Son) have crossed 10year long residence, should I apply SET LR application for every individual or I can apply together with Mom and son. Please help me with this queryy.

Set LR does not allow dependents. Each person has to apply on their own and meet the requirements individually.

Thank you so much, I have now applied the ILR for both my dependents.

I have one more question, I received my British passport a month ago but I am yet to receive my original documents (Indian passpor), when will I get it, also how to chase them back ? any contact details please.
