Earliest to apply! this is confusing and solicitors giving different oppinions

Hi all,

My brother is really confused, wondering when is the earliest we can apply for FLR set (m) 5 years route spouse.

We've asked a few solicitors and we got different opinions, which makes this very confusing...

Date he entered the UK on this route 17/04/2017 (date on BRP 25/03/2017) basically he was given a 1 month visa to enter the UK and then collected the BRP here.

Then he applied to extend in January 2020 and was granted the FLR February 2020 which will expiry 28/08/2022

Does he need to wait until 1st of august (28 days before the FLR expiry?) or can apply anytime now?

The date of the current visa expiry is irrelevant.
For the family route, the eligibility date is: the date of first entry plus 5 years minus 28 days
