Hello Everyone,

I hope you are well.

I'd really appreciate some advice regarding the 180-day absence rule when applying for ILR.

I intend to apply for my wife's ILR in August 2022.
I just need some clarification on what this 180-day absence rule means in our situation and what evidence we require to ensure we are compliant?

Since her arrival to UK in September 2017, The following periods of absence are true [These were all holidays]:

1) Trip to Spain [April 2018] - 5days
2) Trip to Croatia [May 2018] - 6days
3) Trip to France [September 2018] - 4days
4) Trip to Spain [January 2019] - 3days
5) Trip to Pakistan [March/April 2019] - 21days
6) Trip to Pakistan [October/November 2021] - 28days
7) Trip to Turkey [May 2022] - 7days (PLANNED)

Total days abroad since entering the UK = 74days

Can someone advise on what my situation means in relation to the 180-day absence requirement and what evidence we require from our side.

There is no absence limit for spouse visa holders.

The 180 days absence limit applies to PBS route visas.

We have recently renewed her Pakistani Passport.
Do we need to submit a copy of the old passport which expires in May 2022 along with the ILR application? or will the current passport suffice?

Good Morning All,

I was planning to submit the online application for my wife’s ILR on 16/08/2022, however we have had some changes regarding our employment situation.

She has lost her job altogether due to the closure of covid-19 test sites, where she worked, in the wake of relaxed covid regulations.

I have now been told my employment will end on 1st September 2022. What impact will this have on the application in terms of meeting the financial requirement. We both, individually, earn above £18.6k but of course, if I no longer have the job after submitting the application - could that be grounds for refusal?
What should I do in this situation?

Can you elaborate on this a bit more for me please?
My wife has lost her job this week [non-salaried, £20k/year]
My 12month fixed-term contract ends on 1st September 2022 [salaried, £30k/year].
The planned date of application was 16th August 2022.

What makes category B the most appropriate and why does that change anything if my contract is coming to an end 2weeks after I was planning to submit the application?

Just curious to know whether they will only consider the situation at the time of application or whether they will see the fixed-term contract has come to an end and refuse ILR based on my employment coming to an end, regardless of whether I instantly have a new job or not.

They will use the date of application but to be on the safe side I suggest using the category B so that the whole 12 months can be considered

Hi Everyone,

I was compiling documents for my wife’s ILR application this month but am a little stuck on whether my documents to prove cohabitation are sufficient as they don’t feel like they are from very ‘professional sources’. My wife and I live with my parents and so don’t have any correspondence in joint names except 1 bank account. I’d really appreciate some guidance on whether the documents listed below are okay.

Joint:
Barclays Bank Statement April 2020

Applicant [wife]:
HMRC Letter April 2020
Letter from Previous Employer December 2020

Some say Bio pages and stamped pages. I advise all pages, it then feels like you sent them your passport like it normally used to be.

i.e. Spouse Passport Copy (not sure if it’s required anywhere yet)
Parents passport copies as we live with them and the property is owned by them.

Do these need to be entire passport copies too or just the bio data page?

Just the applicant and spouse. Your parents don't need to feature in this application at any point. Regardless of the fact that you live with them.

The quotes above are taken from the checklist produced during the application process suggesting that I definitely need some form of ID for them alongside a letter from them saying I have their permission to live there?

Data page in this case should suffice. For your parents I mean.
