Clarity on FPS

Background: I'm on a T1E (200k) visa and have had it extended recently. Next step is ILR. I used a lawyer to submit my extension application but would like some clarity regarding FPS documentation used in successful applications.

My reading of the requirements is that we demostrate that all taxes have been paid on employees' salaries where they are being used for the application. This is achieved by submitting FPS documentation, however other than XML files my payroll system doesn't provide individual level data. It only produces a rolled up P32 report that shows the totals for all employees (including those not on the application). Can I get some input from people on what they have used in the same/similar situations and been successful in their applications? I really don't want to have to change payroll providers just because of this. My lawyer doesn't like XML files but I think I am going to insist that they be used. To me they should be sufficient. Any reference material that shows XML files are acceptable would be appreciated too. Any payroll software or providers who can provide individual level FPS data would be appreciated as well.

There are many detailed discussions on this issue I had with people years ago under the Tier 1E forum. I often suggested that simply making good looking reports from XML data and sending those. In a nutshell, you may submit the raw XML files, however, it is better if you use a payroll software to simply convert your XML to nicer looking FPS reports (without any submissions)

T1E jobs requirement

Hi everyone,

I will be applying for ILR via the Tier 1 Entrepreneur path next year in August, all things going well. I have invested in two companies and am a director in both. When renewal comes around, if one of those businesses has closed down (and I am no longer a director) but it employed all the people who I intend to use for the application, can I use it in the application? I will still be a director of the other business which by then will have several people employed but they won't meet the one year employment requirement.

This is not necessarily going to be the case but I would like to understand where I stand in case a contingency needs to be put in place (I have several possible contingencies).

I've also always been somewhat confused by the employment of 2 people for 1 year thing. My lawyer told me that 4 people for 6 months (or any combination of p x m = 24) won't cut it but I have seen suggestions that this is not the case and 4 people for 6 months could be used. Clarification welcome.

As long as you created or maintained at least two POSITIONS that existed for 12 months each (since your extension), you are OK, even if it was in a previous business. You could not use 4 positions for 6 months unless the COVID concession applies.
