What is correct category for ILR ? family visa or dependant or a work visa

Hi Friends,

I am currently on PBS dependant visa, while my spouse has just got ILR based on here PBS/Skilled worker visa 5 years route,

I am now trying to apply for the ILR and it is showing two categories like below among which i am confused among -

partner (family visa)
Apply as a partner (dependant on a work visa)

can you please help me choose correctly - thanks in advance.

You complete form SET(O) for PBS route applicants and dependents. Family route is not relevant to your visa category for ILR.

Thanks @CR001 moderator for the prompt response,

interestingly, I have tried progresssing as PBS route applicant-dependent which say SET(O),
but i wasn't asked to prove or upload any mandatory documents for proving our relationship/marraige!

Also, it did not ask about any leave of absence 180days kind of question aswell anywhere
I am confused if I have selected the right category,

Can you please eloboarte on above two points if the SET(O) application asks about these two anywhere ?

Hi Friends,

I am filling PBS dependant ILR application set(o) and it has not asked anywhere relationship/marraige proof or any documents to upload

Am i missing anything like a wrong category or so, or it doesn't generally ask ?, the gov uk website says i need to prove but the questionare/document list does not ask anything

Please suggest - thanks in advance

Hi Friends,

I am filling PBS dependant ILR application set(o) and it has neither asked me anywhere about any absences in the last five years nor about the 180 days consecutive absence in any year !!

Am i missing anything like a wrong category or so, or it doesn't generally ask ?, the gov uk website says i need to be NOT absent for 180 days consecutively in any year but the questionare/document list does not ask anything

Please suggest - thanks in advance

The checklist is generic. You should follow what UKVI guidance and rules state. 2 Years evidence of cohabitation is required.

PBS Dependent ONLY have absence limits for visas issued on or after 11 January 2018. You have note stated in your posts what dates here visas and if relevant, visa extensions were issued.

There would have definitely been a question about if she was granted a visa after 11th January 2018 etc which you need to answer as either yes or no.

Yes our PBS dependant visa is issue on 7th Feb 2018 (just four days before the new 11th jan 18 rules then!)
and yes i have answered this question as NO - and that confirms why we are not asked for the absence

Almost the last one before i submit :D

When did you first enter the UK?

Should this be the date of my PBS dependant Visa issue date (7th Jan 2018)
or infact i have come to UK an year before that itself on ICT visa (11 Sep 2016) and then applied/switched as PBS dependant within the country UK (not like going back to home country & not entering again on new visa) :)

Was this visa issued for 5 years then?? Or 3 years and you applied for an extension within the UK at some point?

Yes, 3years visa is issued at that time on 7th Jan 2018 and got an extension for couple of years which is valid till July'23
both pbs dependant visa swtich/issual and pbs extension are applied within the uk country but i first entered the UK in sep 2016 on my own ICT

Can you state each dependent visa start and expiry dates please. It is impossible to help if you don't provide the finer details.

If a dependent visa extension was granted within the UK after the initial dependent visa, then you have to answer YES to the question about a visa issued after 11th January 2018 and declare absences taken during the visa.

Oh ya, thanks for alerting me that i have to answer yes (for question any leave since 11th January 2018) and declare absence which i have completely missed that visa extenation is seperate leave grant!!

pbs dependant extension issue was 06th May 2021 valid till 14 Jul 2023
pbs depenant visa issues was 07th Jan 2018 valid till 14th jul 2021

I am editing and submiting my application now to pay priority fee

Do i need to decalre absences that i took after 07th/11th jan 2018 alone right ?
I hope i dont need to decalre the absences i took in 2017 when i was on my ICT visa as its not relevant for this application.

please alert anything else i should know - thankyou alot for alerting/correcting.

P.S. for question when you first entered uk - i have filled as 07th Jan 2018 as description says " this is the date on which you are basing this application", so though i have came to uk first in 2106 on ICT as that is not valid - i am not putting 2016 - please confirm this aswell, thankyou :-)

You ONLY need to declare absences for a visa period ISSUED after 11 Jan 2018. So Only absences from 06th May 2021 must be declared
