Hello Advisors,

Thank you for doing a great job to help everyone with their immigration queries. Really appreciate it.

I hold ILR for nearly 10 years now and my dependents (Wife and Elder Daugther) are PBS dependent visa (Tier 1 General) for nearly 6 year now. Their current visa will expire in June 2023. I have got few questions and would appreciate your help.

1. Will my dependents go through 5 year route?
2. If yes, should I apply as Parter and Child of Partner as a family visa or dependent on a work Visa ? Good to get the confirmation
3. Also, my second daughter was born in the UK last year. I have got her Indian passport and her UK visa also expire along with my wife and elder daughter. Should I apply for her ILR now as I am on ILR and my wife will get the ILR at the same time?
4. Alternatively, apply for her citizenship as she was born in the UK and I have got 10 years ILR. Would like to know the options for both 3 and 4, please.

Thank you for your help.

Regards
P

Yes.

If they hold PBS Dependent visas for 5 years, there is only ONE route, form SET(O) as PBS Dependents.
3. Also, my second daughter was born in the UK last year. I have got her Indian passport and her UK visa also expire along with my wife and elder daughter. Should I apply for her ILR now as I am on ILR and my wife will get the ILR at the same time?

This was already answered in your other topic!! Why are you asking about the UK born child again?? A UK born child does NOT require ILR!! You have also specifically been asked not to post ILR and Citizenship questions in the same topic, they are different rules and process (and sub forums)!!

Thank you for answering the questions. I was not asking about citizenship question here. Want to know how the ILR route for dependents works as my younger one has the PBS dependent visa already.

UK-born children do NOT need ILR. They have an entitlement to be registered as British when one parent settles.
