ILR SET(M) Questions

Hi Guys,

Need some advise on following question.
We are soon going to apply for my wife's ILR SET(M) application via 5 years route. I have following questions. Please help me to understand.

1. I am currently in India due to my mother's health issue and my wife is in UK. So I would like to confirm if my wife can apply for ILR while I am out of UK.

2. In last 12 months I have changed my employer. I am with my current employer for 5 months and I can get employment letter from them, I can also submit the payslips from previous employment but I am not sure if I can get an employment letter from them. So I would like to confirm if submitting only current employment letter is enough.

3. English language, In initial and extension of spouse visa my wife used UKNARIC letter to prove her Degree was taught in English. Can we use the same UKNARIC letter and Degree for ILR application.

4. Cohabitation . Can we just submit 1 source (bank statements) 6 letters or do they have to be from different sources.

5. Residence addresses in last 2 years section:
During last 2 years we had to live in India for 6 months, we still had the house in UK. So in this section do we have to mention the address we lived in India for 6 months ? Or just UK addresss as this is my residence address.
We have mentioned that we are away from UK for 6 months in section related to absences from UK in last 5 years.

6. P60, I do not have current P60(2022-2023) and as I have changed employment not sure who to contact to get full P60. So can I just submit P45 from my old employer? And leave the P60 out.

1. You can only apply for ILR within the UK
2. I do not see any requirement that you need an employment letter from a previous employer. You must apply under category B though. Read the guide very carefully: https://assets.publishing.service.gov.u ... rement.pdf
3. Yes, If the old NARIC certificate was obtained under the Red route
4. You are advised to cover the last two years using at least 3 sources
5. No need to put any foreign addresses
6. We just finished the last tax year at the beginning of the month so you should ask for your P60.
The guide says the caseworker can be flexible:
In addition to the evidence listed above, paragraph 2A of Appendix FM-SE specifies
that P60(s) for the relevant period(s) of employment (if issued) and a signed
contract(s) of employment may also be submitted in respect of paid employment in
the UK. If they are not submitted, the decision-maker may grant the application if
otherwise satisfied that the requirements of Appendix FM-SE relating to that
employment are met, or they may ask for the documents to be submitted in
accordance with paragraph D of the Appendix.

So both applicant and sponsor have to be in UK for applicant to apply? Applicant is in UK now but I am the sponsor and I am out of UK.

The applicant needs to be in the UK and attend the appointment
