My wife eligibility for ILR

Hi team,
I am looking for some help regarding my wife's eligibility for ILR.
Below are the important dates related to her ILR eligibility.
1. Visa Vignette Start Date- 02 Sept 2020
2. Date entered UK- 17 Sept 2020
3. Current PBS Dependent Visa expiry Date- 15 July 2025.
4. 5 Year Continuous Period from Visa Vignette Start date- 02 Sept 2025 ( hope this is correct to consider). Case worker has pick up the application on this date or after by which wife would complete 5 year continuous period

Considering the provision where date of decision is favourable to the applicant, I am planning to submit the application and take biometric date as follows:

Planning to submit ILR application- 13 July ,2025
Will take Biometric Date- 02 Sept 2025 (within 45 working days)

Based on above planning, do you think my wife's ILR will go through. Please advise

Note- I have already got ILR last year.

What are the visas that she has resided in the UK under?

Different visas have different requirements for ILR.

My wife is on Skilled Worker Dependant Visa.
I got my ILR last year under Skilled Worker Visa route.

Hi zimba,

As per my previous post, I am planning to book the biometric on 2nd Sept 2025 which is well within the 45 working days limit after submitting the application on 13 July 2025. I am playing safe here with booking biometric on 2nd Sept 2025 and relying on date of decision.

However I just want to understand if I can also book biometric appointment as early as from 6th August 2025 ( 28 days before completing 5 year of continuous residence)

Please clarify my understanding.

Hi zimba

I am bit confused now.
If I book from 6th August 2025 and the case worker picks the case immediately, then my wife will not be completing 5 years(2 sept 2025) by then.

The whole point of relying on date of decision would not favour us in this case.

Correct me if I have any misunderstanding around the rules.

The 28-day concession means you will be eligible for ILR (i.e. ILR can be granted) within 28 days of completing your qualifying period. The confusion often arises because people do not understand this concession and somehow think it just allows you to apply early but it actually allows you to get ILR early !
