Hello, I am in a similar situation, can you pls guide me.
I have spent 5 yrs plus on dependent visas , a mix of T2 ICT and SWV... to be precise 6 yrs on ICT dependent and 3 yrs 8 months on SWV dependent). My husband has got ILR via long residence, he was on swv when he gained the ILR.
now I want to apply as dependent partner ILR category - can i show my 5 years as dependent using the mix of dependent visas i have had ? or should i continue on my swv dependent visa and reach 10 yrs long residence or 5 yrs Skilled visa route which ever is earlier.

DO NOT tag your question on other posts :!:

There was never a separate dependant visa route for dependants under each part of the PBS system at all. This is a common misunderstanding. Under the old PBS system, there was just one PBS dependant route, so all dependants under the PBS system were issued visa under the same exact route. Under the current skilled worker rules for ILR, time spent under ANY dependant partner route counts towards ILR.

You can easily apply for ILR under the skilled worker dependant route and using form SET(O). It is irrelevant that your husband settled under the long residence.

You should NOT apply using form SET(M) because your husband has ILR now. That is another major error !

Read: DO NOT apply using form SET(M) if you are a dependent of someone under a work related route
