Work Permit Dependant and now Tier 2 Dependant apply for ILR

Hi everyone,
My situation is as follows:
I come to the country on June 20, 2005 on work permit.I got married with my wife on the 20th August 2008. That's why she got the Work Permit Dependant Visa. In May 2009, I had my Tier 2 Visa and that's why my wife got the Tier 2 Dependant Visa. Now both visas expire on the 31st February 2012.
My five years will finish on June 2010. I gave a call to HO last week and asked whether my wife can apply for ILR same time as mine. The lady said confirmed that. I reminded the 2 year rule(319e) since my wife is on Tier 2 Dependant Visa. She insisted that she can apply same time as mine. When I asked the reason she said because of my wife come to the country as work permit dependant in August 2008, old rule applies which enable us to apply at the same time.
I asked the question twice so we will apply at the same time.
