ILR success - initial gap in EC grant date & actual trav

Hi all,

Hope this helps to all who are going through the process-

My situation –
WP for last 5 yrs. Same employer
EC valid from – 20th Jun 2006
First entry in UK – 06 Aug 2006
Date of ILR application – 26th MAY 2011 @ Croydon – 12:00 noon
Result: ILR granted

Dependents: wife & UK born baby

Two points and for which I feel makes it very important to post my experience about my ILR and the process
1. There is an initial gap between by EC granted and entry to UK which is of 47 days. My WP leave was valid till 20th Jun 2011 and hence I applied for 26th May. This was based on revised Calculation of continuous 5 year period guidance. In my case though I was not there in this country for 4 yrs 11 months before I applied I think they have used the clause from this document and hence my clock was started from 20th Jun 2006 and not from 06 Aug 2006.
2. As my daughter is UK born we did not add her to my ILR application. We are planning, and I have confirmed with British nationality authorities, that she is eligible for registration immediately after we (parents) get settled status.

Documents carried
• Appointment confirmation letter
• Detailed covering letter having Personal absences
• SET(O) forms
• Photographs with name on the back
• Passports
• Life in the UK certificates
• Workpermit copy

• 60 months salary slips
• 60 yrs bank statement
• 60 months Savings bank statements
• 5 yrs P60s

Employment letters
• Original employment contract
• Employment letter – specifying the current designation, salary (with confirmation that it is above the one set in code of practise for equivalent job description)
• Business travel letter
• Latest Promotion letter

RESIDENCE PROOF & CO-HABITATION
• Mortgage statements
• Land Registry Certificate
• Electrol roll registration certificate
• Council tax letters 2008-11
• Driving Licence counterpart for both of us
• Water Bills 2008-11
• Electrc and Gas bill 2008-11
• Marriage certificate
• NHS registration cards.
• NI number cards for both of us

I know these are more than enough documents but personally my preference was take more than (and everything I have) required. You never know when you need what depending on what sorts of questions that may arise during interview. So having more than one document to support your response would help.

I had separate plastic folder for each document sorted by the type.

For the absences I added appendix to my conveying letter and added all dates with the details of the page number for relevant immigration stamps.

I kept 3 payment pages ready with 3 different card details just in case the one I am planning to use does not work for some reason or declines the payment. This was extra precaution even after calling them and informing in advance of the possible payment. Being an IT consultant I am well aware of systems goofing-up at crucial time :lol:

I was at the gate at 11:20 am
Questions, Documents asked on the verification counter at the ground floor:
• Appointment confirmation to start with.
• Completed Form O
• Life in the UK Pass letter
• My current passport
• Letter from employer
• 3 months of payslips.

• She asked me if I had been in the same job
• Confirmed whether there are any absences more than 90 days and total absences which are unpaid. In my case there were none unpaid but I had total 178 absences. 101 of these were business related and 77 personal leaves inline with annual vacations.
She then stamped my form and given my the token number

After that I had been asked to go on the first floor and pay the fees. After paying (payment went on first card!) the waiting game began. My appointment was at 12 and all the above was done by 11:40 am so I was hoping to talk to case worker by 12 but I had to wait till 1.45pm. It was too noisy and too busy there and hence in a fear of missing the announcement, I asked on the service desk (counter 22) whether my number has been called. The lady said “no we are running late it will be called soon.â€

Have you been asked for 12months bank statement and pay slips.because in application they only ask us to submit 3 months

Yes the caseworker asked me for 12 month's Sal slips and bank statements.

Hi,

Congratulation!

Did you make covering letter stating the reason why you have "gap" on entry clearance and date of entry?

Sorry but I'm a bit confused here, you said that you EC was on 20th of May and enter 6th of August and applied on the 26th of May??? then your leave sould had been expired on the 20th of May... so how come you were granted ILR after 6 days of overstay?

Please correct me if I'm wrong.

I did prepare covering letter but i did not mention anything about the initial gap.

Sorry EC was granted and valid from 20th Jun 2006. My mistake.. corrected in the original description.

Thanks a lot, manyaonisland for posting your experience. I am in the exact same boat (5 yr work permit expires 15 Sept 2011, but 5 years will only complete on Nov 18, 2011 because of late entry into UK).
Hearty congrats to you, and a big thank you to you - I havent come across any other users on this board who has put that "under 3 month" theory into practice successfully.

if your child in born in UK before you getting ILR then you can 'register' them (using form MN1) as British citizen once you gt ILR.

hope this helps.

Hi There, Congratulations!

Would you pls confirm that as your visa was expiring on June 20 2011, even if you applied on May 23 2011, you still would have been ok per the 28 day prior to expiry rule.

I had recently raised a similar query here to this forum and some moderators and senior members think I may not be elibible for ILT. My case is as follows:

Passport stamped with Work Permit (old style) for entry clearance valid from: July 2, 2007
Actual landing in / entrance to UK at Heathrow on: July 7, 2007
Transferred to Tier 1 General on June 4, 2010 (expiring on June 4, 2012).

By my calculations, I am eligible for ILR on June 4 2012.

Please can you provdie an opinion. Or any other Senior Members / Moderators.

Child Registration

Congratulation and thanks a lot for your valuable information. This is really helpful. I am on the same situation as yours. I am eligible for ILR in May 2012. My wife is pregnant now and her expected delivery date is end of November 2011.

I am going to do the same as what you have done, however if you could assist me with the following questions would be really helpful.

1. Have you taken your country passport for your daughter after she born in UK? or her birth certificate from NHS is sufficient?
2. Have you mentioned your daughter's situations & details in the covering letter & application
3. How long is the gap between your daughter's birth date and your ILR Appointment date?
4. Who did you get the confirmation from (British nationality authorities)?

Kindly confirm this as we are planning to take some decisions based on your response.

Hi everybody,

As an update: I just got my employer's legal counsel to confirm to the HR group and myself, that my 5 year anniversary i.e. July 2 2012 (i.e. 5 years from the date my passport was stamped and not July 7th the date of entry to UK). Therefore I am eligible to apply for ILR on June 4th 2012 (28 days prior to July 2 2012. As my current visa is valid till June 4th 2012, I can apply for ILR on this date and do not require any extension.

I am hoping this helps thos others too whom are short of the requirement of 5 years. It appears as long as you entered soon after visa was first granted, the 5 years is from date of stamp in passport and not date of entry in UK.

This is a wonderful thread, I entered UK 60 days after I got my HSMP visa, so I understand that I am within the 90-day rule and therefore I can apply for the ILR even before I have completed 5 years.

However, there is a section that clearly asks if you have completed 5 years of lawful stay in the UK. What do I write there ? A "Yes" would be incorrect and a "No" could be dangerous for the application. Any suggestions ?
