ILR - WP query

Hi members, can anyone please advise what exact document UKBA needs for following requirement on Page 33 of Set O form? Is it just passport?

Document(s) confirming that you have spent a continuous period of 5 years in the UK:
- either as a work permit holder throughout that period, or
- as a work permit holder most recently, combined with previous permission as a work permit holder, highly skilled migrant, self-employed lawyer, or as a writer, composer or artist.
-------------------------------------------------------------------

Based on Set O form for old work permit holder I have collected the following documents. Can anyone pls confirm if I have missed any?

Passport & Immigration documents
My old passport
My new passport
Wife's passport
Official work permit doc from HO
2 photos for both

Cohabitation documents Last 2 yrs - Feb 2010 to Feb 2012
Tenancy agreement 1st Feb 2010 to 30th Jan 2011
Tenancy agreement 1st Aug 2011 to 30th July 2012
Marriage certificate
NHS cards (both - April 2010)
NHS letters (both - May, July, Aug 2010)
Letter from GP (Joint - Dec 2011)
HMRC Tax Letters (Both Nov 2011)
Harrow Council (Both Dec 2011)
Wife's pay slip (last 6 months)
Wife's P60s 2 yrs
Barclays statements (Joint - Dec 2010 onwards)
HSBC statements (Joint - from 2008)

Finance documents
My P60s last 4 years
My pay slips for last 12 months
HSBC current a/c statements (Joint - from 2008)
HSBC saving a/c statements

Knowledge of language
Life In the UK Pass Notification (Both)

5 year continuous stay
Employer letter with SOC code

Your advise will be greatly appreciated. Just got a few weeks left for any missing docs.

Hi there,

is your work permit with a single employer or you switched to another employer?

I have similar case but I once changed the employer...

hi dev...

your list looks fine. should not be problem. infact, u have too many docs for wife. but its good to carry all. i m sure they will not ask all.

only one question - why u hv only 4 years of p60? if u dont hv for any year, u can call hmrc and ask them to send 'employment history'. its accepted by ukba.

Hi Yogi

The reason why I have only 4 p60s because my 5th yr p60 will be sent to me on 5th April 2012. I came in the UK in March so for the last year I will have to wait until April.

Hi members,

Can you please advise. I am increasingly getting mixed views.

I am falling short of 5 days in my eligibility for ILR (Visa stamped as 13/02/07 and first entered 17/03/2007).

Some are advising that I can go for same day application as my rest of the case is strong and that case worker can consider short fall because it is within 3 months.

Others are advising that the 3month delay is not a rule but a case worker consideration and hence I should not take a chance and just do postal application near to 2nd week of Feb.

I don't want to risk my case but really confused if I should do postal application to cover the short fall or just do the same day application?
Any advise will be greatly appreciated.

Hi members, just have two queries,

Can anyone pls advise

1st all proofs of Cohab are in my family name but my wifes passport has her family name. I have the marriage certificate. Is that a problem?

2nd I am very confused if I should do postal app or POE. I have a shortfall of 5 days in 5 yrs. I am on old WP, delayed entry by 32 days, giving me shortfall of 5 days. I am getting mixed views. Some are advising my case is straightforward as I am covered by 3months rule. And others are advising I should not take a chance do postal app which means delaying app to last minute and hope that when it reaches case worker 5 days have gone. The 3month rule is not really a rule but case workers consideration.

Any advise will be greatly appreciated.

Send your application as postal application. Because by the time it is decided you will have completed your five years.

There is no problem with your wife name, as she is in UK with the same name and UKBA has record of everything. If, however, you want to include the marriage certificate, you can do that.

Zahid,

Just a quick one.

Since the WP was issued in 2007 my salary has gone up. When last I submitted the technical changes for job title change HO recorded £25k. I am now on 35k in line with my relevant SOC code.

Is that a problem in terms payrise?

Hi respected members/moderators,

Can you please advise on the following:

1. I have a total of 67 days absences 4 of which were unpaid leaves. Do I need a letter from employer confirming this?
2. My salary has since getting WP gone up from 25k to 35k in 5 yrs. Is that a problem?
3. What is the best method of payment in postal applications? I am putting file through solicitor and he is suggesting I pay the application fee to his company and he will pay to the UKBA to ensure payment goes through. I just don't know if this is a good practice?
4. Based on recommendations I am thinking of doing a postal application (falling short by 5 days overall). If I am falling short by only a few days can I not do same day application to avoid painful waiting game on postal application? Will UKBA refuse my application if I am falling short by a few days in same day applicationn?
