EEA return of Passports but no damily permit

Hello,
I have a big problem.
My husband applied for EEA2 family permit. We applied in June and never received a confirmation of application. We finally wrote them a letter end of August We wrote to the EEA Liverpool and we send an email to the liverpool.retunrpassport address.
The shocking thing now is that today we received our passport and marriage certificate but the letter says nothing about the family permit.
The letter says:
"Re: Your documents are being returned to enable you to travel.
Family members of an EEA national, who are not themselves EEA nationals, wishing to return to the United Kingdom should apply for a EEA family permit at the British diplomatic post abroad before returning to this country. An EEA family permit is issued free of charge and on a priority basis.
It should be noted that any such application would need to be supported by evidence to show that the EEA national is in the United Kingdom, is exercising treaty rights, and that the relationship is as claimed.
please do not return your Passport to thee Home office until it has been requested by a caseworker. "
I don't understand the should we wait now or get a lawyer???
PLEASE HELP ANY INFORMATION CAN HELP

what did you write in your letter?
seems to me they thought you need your passports back and your eea2 application is still being processed (can take upto 6 months to get coa)
why don't you call them and ask what the status of your application is.

Well,
how I said I did write to te liverpool return address. Thougt we would get a CoA or family permitearllier when I request them back.
So I tried to cal them but they only have this machine wic tells you about te information you can get from the website.
Iwill try again on Monday.
I will have to ask about the status than??

call this number (01516725626) and you will get a machine menu....press 1 ...then press 2 int the second menu....then you will be put through and get another machine with music and some info.....wait about 30 minutes and an officer will pick up:
01516725626 (choose 1 , then choose 2, then wait for officer)
be glad u got your passport back....i doubt they cancelled your application.
by the way,be ready to give the mail tracking code of your application parcel to the ukba officer (if u have it)...it speeds things up

It's not VERYCLEAR why you have a big problem or why you need to get a lawyer involved.
1. You should have received a certificate of application immediately.
2. your application is not considered as being withdrawn, it will still be processed.
3. You have applied for a residence card not a permit.
4. You can travel, but if you are a visa national and your original EEA family permit has expired, you will need another one to get back into the UK.

I know we should receive a confirmation letter immedaitely but they didn't sent one.
I was just worried why there isn't a visa no the passport does my husband get a card like I had the residence card.
Thank you for the number I will try it today and then let you know what happend

It is not so much a case of worrying, it is simply a case of being patient i'm afraid. It would appear that they had not processed your case at time of passport return.

Hello,
so a little report from my side what happened next.
We received our passports and marriage certificates (al documents we sent) then there was Bank holiday on Monday and we gave them a call on Tuesday.
The lady said we requested the documents back that's why we got them. I wanted to now if the application is still under process she said it is. I asked here where the confimration of applciation is then.
She said my husband (applicant) is in the shifting phase which means all documents wil be checked if they are valid or not. If they are then the applicant receives the certiication of application. And we should wait. I told her the visa is expiring nex month and she said that we should just call again.
We received our CoA same week on the friday.
