EEA2 working tax credit

HELLO,
I am new to this forum could some one help me please.
I am European national working full time,my wife is on eea fp for 6 six months just want to know if i claim working tax credit for myself does it going to effect my wife's application when we applies for EEA2,does it comes under public fund
Can we apply for EEA2 now or we have to wait till the lat month of visa

A worker is entitled to claim tax credits, see Chapter 12 of the ECIs. Make sure you make it a joint claim. Apply for the Residence Card as soon as you fulfill the criteria for residence and economical activity (work).

Hello Losenroy, a European National exercising her treaty right by working is entitle to all benefits which includes working tax credit. From experience, you will be fine and its not going to affect your wifes application whatsoever. But make sure its a joint claim.
From your post, it is obvious you are working. I will suggest you apply for the resident card as soon as possible. you dont have to wait till the last month.

No. Only so called 'income-based' benefits can be received. That's why I always suggest to read aforementioned chapter because it lists those public funds explicitly which are accessible to not yet permanent resident EEA nationals and their family members.

Tax Credits are not classed as benefits.
The credits are administered by HM Revenues and Customs and not the Department of Work and Pensions.
They are of course a government fiddle to manipulate unemployment rates and reduce or surpress the number of 'benefit claimants'.
Benefits in nature but not in name.

Statistic fudging aside, is this possibly a simple formula for EEA nationals: stay clear of any DWP payed monies?

No. But if an individual entitlement to such benefits has been acquired as of right, then such a person needs to be sure that claiming will not impinge on other current or future EEA entitlements such as family renuinions based on dependency etc.

Right. I just realise that JSA for example is paid by the DWP.

Now I see my own confusion: contribution based public funds are no problem (I guess JSA(C) falls in this category) while income-based public funds, the ones listed in Chapter 12, may affect the residence status.
But, are Child Benefits really income-based? (There were plans to introduce exactly that).

Thanks every one as i understand i can claim anything as long as its from HM revenue.
