Hello people,

I am an EEA-national and my husband (non-EEA nationa) Pakistani

He received his 5 years EEA family permit.

As far as I understand he has the same rights as me but because his immigration staus is limited (5 years ) and not forever like indefinate he willl not be eligible for benefits or only for some where the government body will check the status and stuff.

I know that I can claim benefits but the question is will it have negative influence on his application after 5 years? >>>

Because for the sponering of this EEA family permit for 5 years they checked my work history and that I am not claiming an public funds.

So what if I start now (I can't pay my council tax it' s to high, and we are living in our own flat now)

Could you please tell me what my husband will have to apply for after those 5 years and what documents we will need and if I claim for public fund if it will have bad influence on his application after those 5 years.

Are you working presently? When did you enter the UK?

I am the EEA national how said before yes I am working at the moment.

EEA family permit 6 month issued in 26th March 2012
27th April 2012 entry in the UK (alone)

He received his 5 years EEA family permit
27th September 2012

I worked without any gaps.
He started work but has changed his employer two times. with no gaps though.

So what can he apply for after those 5 years and is it relevant if I have gaps in my work history or not anymore???

The rules for you are that for the period from 3 months to 5 years after you arrived, you need to have been working or be "self-sufficient with CSI" or otherwise exercising your treaty rights. See http://eumovement.wordpress.com/2011/09 ... eed-to-do/

After 5 years in the UK, you automatically have PR (if you have met the required conditions).

His status is simple: it does not matter if he is working or if he has gaps. It only matters that he is your husband. See http://eumovement.wordpress.com/2011/05 ... a-citizen/

His PR would kick in 5 years after the date he entered the UK, maked in bold above


Note that your husband presently has a 5 year "Residence Card". He will next get a "Permanent Residence Card" valid for 10 years.

What does that mean?

I would like to know it I claim benefits and he claims for the 10 years one will it be bad that we (joint application) or me have claimed housing benefit or anything like that???

Because we said in the sponsering application that we don't need any public fund but now we have our own flat and the council tax is very high. I can't pay it.

I know the council will said you are eligible you can but the question here is what will happen in the future is it possible they reject the application or he does not get the 10 years Permanent Residence Card.

Will he stay my dependant now for 5 years and then for 10 years????

If you are working, then "self sufficient with CSI" is not relevant for your situation.

When did you arrive in the UK?

I arreved in October 2009

And I am in full-time work since April 2010
