Application help needed pls

Hi all, I'm an overstayed student lives in uk and recently got married to my lovely wife (from poland) and planning to apply for EEA FP but I have few questions to be solved before do so and thought you guy might help me.

★ since I'm already in side the uk which application should I use (vaf 5) says its only for whom apply from aoutside the uk?
★since home office already know I'm overstayed plus they have my passport with them will it be a problem for me?
★will my fiancé housing benefit claims effect my appliction?
★is it a bad idea to apply on my own without paying a fortune to a lawyer?
★finally is there another type of visa should I consider to be the best way of legalize my stay here in uk?

1st you make it clear that how you satisfy the wedding registrar office without having passport and visa. 2nd if homeoffice is holding your passport then most likely they must have written you to leave uk or something else they want.

Sounds like he is married all ready.
What is you wife doing? How long do you know her? How long does she Live in the UK?

Hi guys, they've sent me a letter attached with my passport copies asking me to show it at the registrar office so that's how we got married, we moved in together about 7months ago though we've known for year and half. And she's been working as a self employed for last two years and recently she started to work in place as a regular worker (not selfemployed) and she only has a temperory contract with them. And finally yes I received a letter yesterday from home office asking me to leave before mid january.

So its kindda emergency situation. Any thoughts?
