Family visit... Difficult choice

Hi all

Please advise as I am not sure which way to follow...
I am a Polish national living in UK for the last 3 years my husband is a Sri Lankan national with a Residence Card valid for next 4 years.
We would like my husbands parents to visit us in the UK thus summer, we would naturally be paying for their visit (flights and accomodation and major expenses)
The question is what kind of visa should his parents apply for??

I was checking the Ukba website for all necessary info and got even more confused...

Think they should apply for a family permit but I am not sure as they just wish to visit us for few weeks...

Please clear this out for us.

They can't apply for an EEA Family permit unless they are dependant on you.

Well i think under Regulation 7 (b)(ii) they can be dependant on the non-EEA spouse or Civil partner too, i believe.

In any case, they should be able to apply for family visitor Visa under the UK immigration rules.

Following the changes in July 2012 only family members of settled person or BC can apply for Family Visitor visa.

In this case they can apply for a General Visitor visa.

I have seen the Family Visitors Regulation, and this seems right.

If this puts EEA national who are not settled within the meaning of paragraph (6)(1) of the immigration rules, that may not be acceptable, but we shalk see.

I will search later for the proper change in the rules (I believe the main motivation was to reduce the numbers of appeals as general visitor don't have right of appeal and Family visitor do).

Are the parents fully dependent on you financially?

Your parents, unless dependent will need to apply for a general UK visit visa. I would suggest you look at that part of the forum.

Yes my parents-in-law are financially dependent on us.

Can you please tell me whether they need two separate applications or is there a way for them to apply together since they are travelling together and they have one sets of documents.

Can they have a visa meeting together?

If they are dependent on you, then an EEA family permit would be appropriate. It's been a long time since I've looked at the form. The on-line version should be in principle similar to the paper version. You can use that as a guide. Does it allow multi-person applications or only individual?

The evidence that one qualifies need only be submitted once of course.

It looks like it allows only individual applications but in that case as you have written and logic would suggest only one of them need to show they meet the criteria of application...

You can link the two applications with a covering letter.

Can u tell me wht documents are u submitting, and how much money in the acoount would be sufficent for this purpose???
