Everyone,

I am looking for any sort of advice or if someone experienced similar problem. Please share your thoughts.

Our situation is that my wife submitted her application for EEA2 this January 08, 2013 and checked it from Post Office tracking online, it was been received January 09, 2013. Until now, almost 2 weeks waiting, We didn't receive my certificate of application yet, I send them an email on ukbanationalityenquiries@ukba.gsi.gov.uk, but don't have any reply yet, I also tried calling their telephone number but still cannot find any answers.

The problem is she is currently working under her Student visa which is due to expire on the 1st February 2013. We were advised that once UKBA receives she could stay in the country during the process. Is that the case ?

Another problem is that there was an update on Application form on the 8th of January and we have submitted ours on the same day but as with old format. The new application form is saying that "This form is to be used for applications
made on or after 13 December 2012". But it was issued only on 8th, we checked the web page on the night of 7th and there still was a previous revision.

If we won't get anything until her visa expired, should she leave the country ? What is the likelihood that UKBA will require to resubmit out form with the new application form format ?

Don't worry about the form. In fact you don't have to use a form at all.

As long as you are exercising treaty rights, your wife can work.

And this derivative right will be easier to prove once she receives her CoA.

I've posted my application on 3rd of Jan 2013, they've received my application on January, 4th 2013 and I'm still waiting Coa.

I've got student visa which will expire on the 30th of Jan 2013

and I've used the EEA2 application version 07/12 as well. Poor us!!!!

Hope we will hear anything soon as my employer wants all my documents about my visa extension.

If you need confirmation, chase UKBa for COA.

Just a small update.
Visa is due to expire tomorrow, COA not received, no news from UKBA and wife's employee asked her to quite due to visa expiry.

Expedite your COA. Get employer to put the threat in writing. Make her employer aware of this

There is also a helpline for employers so they can check their employees right to work. You should encourage employer to use it. Make it clear that EEA2 applied for and COA not received yet.

COA is received 1 month after we have applied.

Another problem now. Passport is due to expire in August this year and RC 6 month deadline will be June/July. How does the RC is looks like. I am assuming this will be sticker in my wife's passport. We've notified UKBA about that, but no response as usual.

Any suggestions how to deal with it ?

I'm not sure what the issue is. If the passport is valid and the HO has it, the RC sticker will be placed in the passport. If the passport is expired or the HO don't have the passport (because you have asked for it to be returned), the RC would be placed on a stand alone piece of paper.

If your passport expire, the RC inside it doesn't expire. You just travel with both (old and new) passports.

Hi Kosta,

I received my Residence Card yesterday. About a month after I applied (and also after I'd received my COA), I requested our passports back. The UKBA never asked me to send my passport back for them to issue the Residence Card (I assume they check everything they need with the passports before sending them back), so I received it as a "Freestanding ISD (Immigration Status Document)".

So, having said all of that - I'd recommend requesting your passports back, this way you'll get a freestanding ISD. Although, I have read that carrying your old passport with RC sticker and new passport is OK - but I guess that depends on your country, and if they allow you to keep your old passport.

She also wanted to take my surname, how painful this process is going to be ?

It seems to me that another headache is occurring...

I'll double check when I get home this evening, to see if the passport number is on the ISD (I'm sure it is, but I'll double check). Do passport numbers change? I would have thought they'd stay the same - make it easier to keep track of people - but maybe I'm wrong.

As far as I'm aware, if she wanted to change her name on her Residence Card (or have it re-issued for ANY other reason) - you have to go through the entire application process again...

Another update on my case.

We've requested our documents back last week. And surpise, today I got a letter with all our documents and passport with residence stamp...

So all process took less than two months.
