Surinder Singh route via Belgium for Mother

I am a British National exercising my treaty rights working presently in Belgium for the past 6 months. Previously I have worked in other EU countries for 5 years. I have been self-employed throughout. I have all the paperwork at least for the past year including my tax statements, work contracts, tenancy agreements, residence card, language classes etc.

I am the only child and I want to bring my widowed mother to Belgium who presently lives in a non-EEA country and is 65 years old.

My goal is to initially bring my mother to Belgium and finally get her a long term visa to live in UK when I decide to move back there.

The options I have :
1)3-months family visit visa to Belgium and apply for a EEA family permit/UK residence card through SSR.
2)3-months family visit visa to Belgium and apply for a Family reunion visa for Belgium immediately and also apply for a EEA family permit/UK residence card through SSR after two months.
3)Apply directly from the non-EEA country for a Family reunion visa and if successful, apply for a EEA family permit/UK residence card via SSR after two months of her arrival.

Or is there a simpler alternative which is less tedious and risky?
Can you please advise me on my options and documents both of us require.

When you say Family Reunion Visa for Belgium do you actually mean apply for an Article 10 Resident Card in Belgium for your mother? (Resident Card for the family member of an EU Citizen).

When you say Family Visit Visa - do you mean that you are applying under EU Directive as your mother is your dependant family member - or under Belgium Domestic Rules for a Schengen Family Visit Visa?

If you mother is your actual dependant and you can provide evidence of such then you can apply for a free visa on that basis. Once she is Belgium she would then apply for the Article 10 RC and thereafter apply for the EEA FP to go to the UK.

If my mother is successful with the above, she can apply for a residence card in Belgium as mentioned in the link above.
Once my mother receives her Belgian residence card, can she travel to UK along with me without any issues?

To live in the UK on a permanent basis what would be more ideal, apply for EEA FP or UK residence card?
I am able to prove that I work and live outside UK in the EU for many years.

Sorry for the delay in replying

Can you please clarify - is your mother dependant on you?

If she is then she should apply for a Schengen Visa for the family member of an EU/EEA Citizen - which should be issued free of charge and in an expedited manner.


Once in Belgium she then applies for a Residence Card for the Family Member of an EU/EEA Citizen (Article 10 RC)

The links you have provided above are not for dependant family members of EU Citizens.

Once your mother has been living with you in Belgium as your non EU dependant family member you then apply for the family permit to bring her to the UK - this permit would be issued under Regulation 9 (Singh) and, as things currently stand, to qualify you (the UK Citizen) needs to have been a worker in the EU state (in this case Belgium).

You cannot apply for a UK Residence Card in Belgium - you have to be in the UK first.

Thank you for your reply.
I will investigate further, the route you suggested.

I have kept a record of all money transfers to my mother’s account in the non-EU country .

Bank account in both our names.
My mother is a widow and I am the only child.
Lastly proof of relationship with my original birth certificate.

Some of the above documents could be considered as proof of inter-dependence. Is that also acceptable?
Or must I only show the record of money transfer to prove only that my mother is dependent on me?

hi,
i also registered my mother as eu family member in germany,they didnt ask any dependency..you just have to prove with your birth certificates and savings.

you are so lucky,you are already outside britain. you just have to bring her on schengen visa and then register as eu family member and apply resident card straight away and 3 months isnt applying to you because you are already outside uk so you can go britain anytime with your mother.
