Then you have

PR.

Did you click on Vinny links?
Unfortunately, because your EU spouse was not exercising her treaty rights so sadly you cannot meet the requirement either for ROR and PR

. I always advise to non-EU nationals to not divorce EU partners until sort their status or at least be assure that treaty rights evidences will be accessible to avoid future complications. In life many heart broken behaviours encounter from EU partners which naturally leads to be emotional but they need to be dealt wisely but patiently.

Hi Vinny!!!
I have read the attachment in your post but i still couldn't understand if permanent residency nullify the need for proof of treaty right of eea partner. Besides does it help if you can proof that eea spouse was exercising treaty right up to the start of divorce proceedings not the end of divorce proceedings. Would be grateful if you can clarify this .i am in a dilemma. Thanks.

If a person has already been granted confirmation of
PR, then they have accepted that the person has been exercising treaty rights for a continuous period of at least 5 years. A person who has attained PR continues to exercise treaty rights by just remaining in the UK and not be absent for more than 2 years.
Currently, the EEA national should be exercising treaty rights up to when the divorce is finalised.

Vinny what do you by confirmation pr? Do u mean by that pr stamp? What if the EEA holding BC without apply for Pr can BC considered as confirmation too as Permanent Residence?
