Hi All

I'll have to apply for my wife PR. She is an EU citizen and has been working since December 2010.
We do have some payslips but not all of them but have all P60s(x5).
1.would these documents be enough to prove her right to get PR?
2.what documents we should provide/present to support her application.

I am non-EU citizen currently holding EU-family member residence document issued in Nov 2012 valid for 5 years(expires Nov 2017).

3.should I apply with her on the same application or I'll have to wait another 2 years and then apply
separately for my PR?

Any suggestions/advise Please.

1) Partly, not completely. See 2.

2) Have you read the PR guidance? its quite comprehensive.

3) When did you arrive in UK?
When did you marry your spouse/sponsor?

Is spouse/sponsor an A8 national? if so how about WRS?
Has either party enjoyed any prolonged absences from UK since arriving in UK?

4. yes my wife is A8 national and WRS was not applied/issued as it was not mandatory for A8.
5. Neither of us have any prolonged absence from UK only 1-2 weeks holidays.

Do you mean you came to UK in 2009?
Its not clear when you married, when was that?

If spouse/sponsor is an A8 national and was working in UK before mid-2011 she needs to have been fully and properly registered for WRS.
Otherwise her work was technically illegal;
- if that is the case her PR clock will not have been running until WRS ended.

So was wife working before mid-2011? (I think you said from 2010).
she may only just have acquired PR around now if not properly registered for PR earlier.

Whether you have acquired PR status will depend on date of marriage and arrival in UK (whichever is later).

In that case, wife may have acquired PR this May, 2016.

You may have acquired PR by November 2016 (5th anniversary).

I was issued EU-family member residence permit in Nov 2012 as UKBA took almost a year to decide my application.

Correct, you do not wait for that document to expire.
- its just a confirmatory document (it does not grant you any status).

Your PR status depends on being the direct family member of your spouse/sponsor (and so depends on your wedding anniversary).

Wife will need to submit documents to confirm: identity, residence in UK, exercise of treaty rights in UK etc.
All as per the comprehensive PR guidance.

Hi everyone

I've come across some other questions regarding EEA-PR application.
In section 4 Absences from the UK,
1. should we have to provide only prolonged absence from the UK or we have to provide details of any absences from the UK e.g HOLIDAYS?
2. If it doesn't apply to Holidays,can we mark this section as N/A or just leave it untouched?
3. If it does apply to Holidays,should we have to provide the exact dates for each year or just Rough guess will enough?............to be very honest can't remember all those silly dates

All absences need to be declared - do you still have email confirmations of flight tickets etc? That's how I pieced mine together.

It's all about proving continuity of residence has been maintained in UK (not interrupted by prolonged absence, accumulated or otherwise).
And, if acquired, showing that PR was not lost by prolonged absence.

unfortunately do not have those e-tickets

Do a SAR to see if HO have any absences/travel data on record for you.
If they haven't just state in the absence section that you do not remember the exact dates you travelled, but that your absences did not exceed 180 days per year (if that's the case - do not lie of course).

How can I do this SAR and how long it will take?
actually I'm gonna apply PR for my wife and she is EU-national and I don't think HO will have any travel record of her.

Some EEA members have been pleasantly surprised by the travel records that turned up in their UKVI SAR.

Could someone please assist what sections to be filled (of the new PR form) to apply for PR(for EU-citizen).

There are some pages before Section 1 containing Biometric subsection and Personal Details subsection.
Do we have to fill out the Personal subsection as well?

If your wife is applying and she is from an EEA country, then she only needs to fill in the sections relating to EEA nationals. You can just discard any other sections. Section 1 Biometric subsection refers to non EEA nationals.

The issue is that form is very confusing and it's very easy to make mistake or fill out wrong section and that is why I have decided to have some help/guidance to avoid any blunder.

Its not a legal requirement to use the latest 'monster' form.

You could use an earlier (simpler) version from Gov UK archives, or this one:

The form a member has mashed up contains latest address and payment details.

Any other old form (eg as may be found in Gov UK archives) would ofcourse have to be accompanied with the correct fee and sent to correct address, (not some old fee and address from 19-forgotten).

1.What EEA form you would sugest for me to use when I apply for my PR as non-EEA family member after complition of 5 years time frame?
I have been looking for the old version of EEA4 form but unfortunately could not find it online.By any chance if you do have a link to that would you please share.

2.shall I apply only when the 5 years time frame is fully completed OR is it possible to apply beforehand for example 2-3 months?
in that case I would be able to Apply on the same application as my wife otherwise have to apply saperatly and 2-3 months later.
