The forum is very informative, atleast more than the official websites. Keep it up guys.

I have a small question, I am an EEA national (german) and I just recently got married to a non EEA national from Pakistan. I am aware that there are no visa fees for spouse of EEA nationals, so that's fine. What about NHS surcharge? I read here at the forum about the IHS charge, I didn't see anything at the official checklist or during the application process. My wife has submitted all her documents at the Gerry's at Islamabad, her passport was kept along with copies of the required documents. I sent the sponsor documents to Sheffield and also got them back in a week's time. Is the process time the same as for all other categories?

Documents Submitted at Isb (Biometrics): 04.08.2016
Documents sent to Sheffield: 14.08.2016
Not straight forward email received: 16.08.2016
Documents sent back from Sheffield: 18.08.2016

What has spouse applied for?

UK Spouse visa?
Or EEA Family Permit?

There is no IHS for those on EU migration route.

You are correct, I just checked the application category it is 'Family Member of an EEA National'. In reality it is a spouse visa of an EEA national.

Sorry I am new to all this, is there a difference?

EEA family members (spouses, children and dependent parents) have a right to accompany the EEA citizen that can not be refused. Family members of British citizens have no such right and can be refused.

British citizens must earn more than £18,600 to sponsor their spouse. There is no such requirement for EEA citizens.

The fees for British citizens sponsoring their spouses is upwards of a thousand pounds sterling for a 2.5 year visa, followed by another fees of more than a thousand pounds in 2.5 years time. Then all things being fine, s/he would be eligible to apply for ILR for another fee of about £1500-2000. So, the spousalvisa of a British citizen costs about £5000 or more over five years.

The fees for EEA citizens is a flat £65 for all applications. So, that would be £65 for a Family Permit and another £65 for the Residence Card to reside in the UK for five years, followed by £65 for a PR Card. That is under £200 for five years.

As this is a query relating to an EEA Route application, can the mods move it to the appropriate forum?

Well written Thank you, a further querry if my spouse does manage to get the EEA Family visa to UK, how long is the initial visa that she will get stamped on his Pakistani passport? Any idea?

Provided she has attached proof that you are exercising treaty rights (working, studying with CSI or self-sufficient with CSI) or have PR yourself, she can not be refused a Family Permit.

The initial Family Permit (which is not technically a visa) is valid for six months. Within those six months, she should apply for a Residence Card using pretty much the same proof as she did for the Family Permit.

Just wondering, for EEA Family visa to UK, the timings are the same as that of Pak spouse visa for UK? There hasn't been much time since the application submission, I know patience is required, no issues there.

What is the next step? Someone will call me to ask about the sponsorship? OR my wife will be informed simply about the decision?

This all is getting very confused and messed up. As I mentioned I applied for EEA family visa for my wife and she got the confirmation from the embassy in Pakistan that her visa was rejected and she was given the passport back. The reasons for rejection are very confusing the visa Officer states:

There was no evidence of employment and salary.
He wasnt convinced that I am doing a genuine job in the UK and if I am exercising the EU treaty rights in the UK.
If i am EEA qualified person in accordance with Regulation 6 of the immigration (EEA).

This all is absurd, I sent in my 12 salary pay slip, the P60 tax documents, my employment documents to the Sheffield office. I have the feeling they were over-looked. Was I supposed to send documents to Sheffield? I got them back rather swiftly. I also got a confirmation that they were received.

I dont know what to do next. Can someone help?

I have a very simple question.

Who qualifies for Regulation 6 of the immigration (European Economic Area) Regulations 2006.
Simply speaking what is the Regulation 7 of EEA Regulations 2006.

As much as I understand if a european national lives in UK like a student, self employed, self-sufficient etc. He is using his EU treaty rights. I am a german national living in Uk since 2014 and earning around 50-60K. Do I qualify? Do I need a certificate from Home Office confirming that?

The ECO (Entry Clearance Officer) apparently did not see the supporting documents. Did they instruct you to send them to the Sheffield Office?

They did and I sent the documents to Sheffield address, I even received the documents back.

Ask the ECO to reconsider in light of your submitted evidence.

Full, printed, signed application form
Original valid passport

Documents regarding EEA national:
Copy of passport page
Copy of payslips (3 months)
Copy of bank statement (3 months)

Documents regarding both non-EEA and EEA nationals:
-Marriage certificate (I provided the original, make sure your partner mentions that she wants it sent back)
-Copies of bills with both our names on it (copies)
-Selection of photos


I want to mention that my partner, the EEA national, didn't have to send in anything to any office in the UK; I just took copies of the above documents.

The application was made in Pakistan?


I am a little confused for the first try, my wife submitted her documents in ISLAMABAD and I sent all my documents (with tenancy, work, tax etc etc.) to Home Office in Sheffield. The reason of rejection was my (EEA national's) wages and status wasn't clear. It was obvious that no one saw the documents I sent.

Instead of an appeal, my wife (Non EEA) submitted a fresh application and this time all the documents related to myself and her have been submitted in Islamabad.

My question is do I need to sent the documents again to Sheffield?

If someone can guide, will appreciate that.
