Hello Everyone,
I submitted my EEA retain right of residence after divorce to home office but the solicitor said you will get another 5 residence card not the ILR as divorce initiation was 3years and half after marriage and I am a 2years resident as family member of EEA
Is it right what the European law sayschool as he claimed?
Also any one submitted EEA application after brexit and received a positive answer from home office?
What is the average waiting time this days ?
It will be really helpful if I get an answers from Dear members

Thank you very much

Laminé :)

Firstly, this is the wrong forum for a specific EEA-route Application and i am sure the mods will move it as required.

Secondly, you do not get ILR, you acquire PR automatically after five continuous years of living in the UK in line with the EEA Regulations.

How many years have you been in the UK as a family member of an EEA citizen?

If it is only two years, then you have to remain on Right of Residence (RoR) until you complete five years and must either be working or be self-sufficient with private health insurance from the date of divorce till the time five continuous years are completed..

See Regulation 10 of the EEA Regulations for more information.
