visa ran out

my wifes spouse visa ran out on the 6th of jan she has faild her life in the uk test twice and is booked in again for the 21 of feb but as her visa as run out i do not think this matters i was going to send it all of when she passed but can i now ?

I think that it's worth passing the KOL test and going for SET(M). 

FLR(M) (285) requires valid leave. However, SET(M) (288) apparently doesn't.

thanks for all the good advice i think i will get the wife through the life in the uk test then send the setM with a good cover letter then just pray hard thanks i will let you know what happens
