Please Validate - ILR PBS Dependant

Hi,

I've appointment booked (20 June) for my spouse this friday and need a final validation from Sr. members/moderators. I've got all docs and application form in place. Just need moderators to confirm absence validation for her.

Visa details
1) 18 Nov 2011 - 08 Oct 2013 (EC - T2 ICT Long Term Staff Partner) - First entered UK 27 Dec 2011
2) 03 Sep 2013 - 09 Oct 2015 (Visa Extended - PBS Dependant)

Is 90 day rule applicable for this case?

UK Absence
9 Nov 2012 - 10 Dec 2012 (total 29 days considering travel dates not counted as absence)
1 Dec 2013 - 2 Feb 2014 (total 62 days considering travel dates not counted as absence)

Total 91 days absence over past 2 years - will this be problem in ILR application?

No, absence should not be a problem as they are of a relatively short duration.

90days rule is applicable only if it is continous. If there is a break, then it is not considered . Your case is fine.

Just to clarify on 90 days rule for continuous - did you mean continuous single visa?
I presume your suggestion is based on extension filed by her as PBS Dependant?

no one cares about continuous 90 days anymore

and no one EVER cared about that for a dependant

and there are no restrictions on dependant's absences

do not worry
