Hi ik_aam_insaan,
Well I meant to say, any document that could make up the 6 documents list, it could be any thing. If you didn't send the tenancy agreement last time, and you have got it now, that is great it's another document, so more documents and more sweeter your dependants SET(M) application will be. If you haven't got a tenancy agreement but you fulfil the list by submitting other documents, than that is absolutely cool. Many thanks.

Sleepless nights with me

I am in UK since 27 march 2004

All apps went fine for extension

T4 expiring in 28 feb 2010 app sent to HO on 25 feb 2010 ... acknowledgement letter 01 march 2010 In time...

App sent back with all docs and pp on 09 june 2010 HO couldn't take payment asked to send new app as new app form was in place 04/10 ver with increased fees

Sent the new app on 14 june 2010 and out of time app says on SAR

Visa rejection letter received on 27 July 2010 as maintenance fund letter was older then 30 days (I thought it was ok to send the previous one.... my bad)

Spoke to a barrister he suggested launch JR which was launched on 31 july 2010 .... later rejected on 10 october 2010 by judge ... reason: no merits.

Meanwhile launched T1 psw app on 03 auguest 2010 ... received visa on 29 sept 2010 valid till 29 spet 2012 out of time app as per SAR

then applied for T4 student in sept and have current visa till 10 oct 2014

Now my question will this visa rejection in July 2010 break my continuous stay for ILR unable to find answers anywhere

Anyone had same situation .... please reply

Hi sams99,
Although your initial application send on 25th of February 2010 was in time, but when they send it back to you asking to fill a new application up the problem occurred there. As you filled your new application, hence your old one was null and void and your application date was 14th June, and that was out of time, means to say as your visa already expired on the 28th of February 2010, so that time between 28th February to 14th June was the gap and I am sorry but that will surely be considered against your continues stay.
I hope other senior members give you opinion about that. All the best.

I agree with shahjee that gap exists but the good thing is that in worst scenario you can win this case in the JR or in the court. I am assuming that your payment didnt gone through.
you can prove that sufficient money was in account and you entered correct details.
why the payment didnt through ? It was not your fault. Ultimately responsibility is either HO or Bank.
I have listen couple of cases regarding payment issue easily favourable for appellant.

Rang home office and they saying, we are still dealing with February Applicants and you will have to wait bit longer because they have not started the March applications Yet.

In 2013 February there was a case of tussle between me and my wife and police was involved. I was taken to police station but later my wife took her case back and i was released from the cell after the statement was taken the same day. will that affect my 10 year ILR application. any suggestion welcome.

Just to share that i received a phone call from UKBA confirming that they have dispatched my documents. I was . Just checked the return tracking number and its on its way. UKBA informed me today that decision has been made and will be with me tomorrow morning. So fingers crossed. I received 2 missed calls from unknown number but literally saw and received the third one which was from UKBA. They confirmed my ID and details and then informed me about this news. I will update tomorrow.

Being a reader for a long time I am posting my 1st quest:
I was granted student visa on 19th July 2004 and entered UK on 15 Aug 2004. No gaps ever since and all applications in time. Currently on Tier 1 General expiring in Nov.
Can I apply now as I have heard that IF first entry is within 90 days of visa date then the 10 yr qualifying time starts from the visa date rather than the entry date. Does this mean I am eligible from 22nd June? Just being impatient
Please advise.. Gurus (Amber/Vinni)
