Exceptional Reason - Primary Evidence

Hi,

I am in UK on an assignment and get paid in UK and home country. However my company does not file tax in UK, and I will be considering this income for calculating the past earnings.

As I do not have tax return for UK salary, will it be a good enough reason to give that my company gives the net salary? I will be submitting the Income Tax return for my earnings in India.

Is your non taxable income include in this defenition ?

30. What are overseas earnings?
When completing the Previous Earnings section of the points scoring assessment, you must declare which of your earnings, during the period in question, have been UK earnings and which have been overseas earnings.
UK earnings will be considered to include any earnings that have been paid either to you (in the form, for example, of your salary), or to a UK based company or business which is capable of being taken into account for the purposes of UK taxation calculations.
Conversely, overseas earnings will include payments made to a business that remain overseas and which are not therefore subject to UK tax regulations.

Thanks for the prompt reply.

I know the whole problem is not having tax information. Our company does not give us any information on the tax. So not sure how to handle this in the HSMP application.

So just wanted to know if a.) I should honestly mention that I only get net salary or b.) Would it better to show this as monthly allowance, so no taxes?

I have all other information like UK salary slips, letter from employer showing UK Salary and bank statements. So do not want to take any chance on the exception reason.

It would be great if you could suggest the best way.

You need to provide reason anyway, as it is particularly asked in the application form. And honesty is always the way I walways suggest. However whether they will accept it or not that is another matter
