Post by navsan8182 » Wed Aug 20, 2014 9:58 pm

Hi guys need some advice regards to my spouse visa. I am currently working and my visa is gonna expire in 3 weeks time and since im not a permanent employee but a contract employee they wont let me work after the expire date on my visa.

What can I do to prove to them as I already told them I am waiting for the response from the HO for my application if ILR. And they are asking for prove. Any one been through the same situation.

Thank you.

In law you have the right to continue working if you made an in time application before the expiry of your visa.

For the whole period when your visa is processed, you have the right to work.

If you are applying via post, you can ask you MP to write to the home office to provide this confirmation, or your employer can contact the employers checking service. If you are doing Premium service, this may not be necessary.

Your employer cannot lawfully dismiss you in these circumstances.

Hi Obie,

Thank you. Yes i did apply before my visa expired. Been 2 mths since submitted application for ILR.

As you mention i can work while my visa is processed but my company needs a letter to clarify. Could i be able to contact the emplyers checking service and get a letter from them myself.
