P60, Employer didn't pay tax, is that basis for refusal?

P60, Employer didn't pay tax, is that basis for refusal?

I have a question.

If an employer fails to pay tax on 1 month,

is the uk settlement visa sponsor liable to be refused?
even though they were paid their salary for that month?

this was their last month before they left that employer and started working elsewhere.

UKBA have refused on the basis of the P60 that only 11 months have had tax paid on them!
The last month, for god knows what reason, their ex employer hasn't paid tax yet.

Who's responsibility is that? I'm pretty sure its employers?!

any tips appreciated so i can pass them on to my friend! very confused!

You might need to contact that employer and also take your refusal to them,I believe you can sue them if you really know how to make such trouble.
You need to appeal and make it clear in your appeal it's not your responsibility to pay tax yourself (only if you're PAYE) and as a result you wouldn't have known the tax wasn't paid.
Do make sure the tax and such been paid before doing this though.
If that's the only reason you were refused,I believe you have a valid case.
May I ask you this,did you inform them you've left the job when your application was with them?
