ILR - Away from UK for more than a year and gap of 185 days

Post by vkumarkulkarni » Tue Nov 18, 2014 2:34 pm

Dear All,

I was working in UK since Feb-2008 until Jun-2013 in Tier 2(ICT) category, however have a gap of 185 during the said period.
After Jun-2013, I had to return back to India as company didn't allow me to continue my stay. Now its been more than 1 year I am away from UK. Is there any possibility that if I return back to UK this year or in 2015, I can apply for ILR even after having these gaps? Request you to advise and help me.

Thank you in advance.

Dear Suresh and Friends,

Please find the details of the dates and see if things can work for me.

UK VISA START DATE UK VISA END DATE UK ENTER DATE UK LEFT DATE COMMENTS
27-Mar-07 23-Sep-09 18-Apr-07 17-Jun-07 WORK VISA
27-Mar-07 23-Sep-09 16-Feb-08 28-Mar-09 WORK VISA& NO GAPS
22-Sep-09 10-Jan-14 30-Sep-09 16-Jun-13 Tier 2 ICT & EXTENSIONS WITH NO GAP IN VISA

There is no gap in the visa until 10-Jan-2014. I want to return to UK some time next year, if there are possibilities of getting an ILR for my case. I have tried to attach an excel file as well which has the above given columns.

Cheers,
Vinay

I am afraid but no. If you will come to UK , you need to have new visa processed . So automatically all your past Visa or permit stampings will get nullified .
One qs.. Why did not you try to get ILR in Feb ,2013 when you already completed 5 yrs in UK ???

@subodh: I was probably misguided saying that my gap is 185 days during the tenure so I may not be eligible for ILR. And also due to some crazy company rules At IBM I had to move back home. However, I later realised that there were few exceptions.
