Tier 1 visa extension urgent advice

Post by obi123 » Mon Dec 01, 2014 6:14 pm

I am currently on my 2nd tier 1 visa which is the 3yrs visa to add to my previous 2years to qualify for ILR but i have over stayed the number of days required for ILR, now my visa expires march 2016 i want to know if its possible to apply for an extension of my tier 1 way before the expiry date knowing the new rule on the tier 1 visa by april of next year. in summary is it possible to extend the tier 1 visa more than twice ? and if possible can i do that up to a year before my visa expires?

is there any other number to reach the work permit.com advice line as i am call from the US and not getting through to the number advertised?

You may extend at any time prior to 6th April 2015. 245CB specifies the Period and conditions of grant.

hi vinny, thank you for your advice

are u saying that's its possible to extend my tier 1 general even if i have been granted a total of five years in total? my fifth year expires in 2016 though, just a bit worried cos i don't think i qualify for ILR anymore cos in the past year i was in the US for more than 180days and if my tier one general expires in 2016 it looks like i am only left with the impossible uk entrepreneur visa or apply for the tier 2 visa, am i right?

calculating days of absence from the uk for ILR

Post by obi123 » Tue Dec 02, 2014 12:07 am

please i need an advice as i am bit confused right now about the days of absence in the uk

I have not been absent from the UK for more than180days consecutively in a year
but these are my day off from the UK this year

01/02/14 - 28/06/14 which i believe is 147 days

09/09/14 - 01/12/14 which is 83days

which is more than 200days but this is not a consecutive absence, have i over stayed my days of allowed absences?

They will combine the absent days, if they are within a consecutive 12 month period preceding the date of the application (34G) for leave to remain (245AAA(a)(i)). So, if you are able, you should select an application date when the absences are less than 180 day in each of the 5 consecutive 12 month periods preceding the date of the application for indefinite leave to remain.

See also example.

thank you vinny for your prompt reply.

now if i am going to apply for ILR i was planning to combine my tier 2 visa and my tier 1 general visas to make it a total of 5years or i use the tier 1 general after it expires in 5years in 2016

i got my tier 2 visa approved in 16/12/09 - 18/08/10
then tier 1 general from 30/03/2011 - 30/03/13
(there was an appeal case in between the two visas thats why there was a space between the two different visas)
then tier 1 general from 30/03/13 - 30/03/2016

my travel dates out of the UK between these times where

15/04/2010 - 27/04/2010 =12days
16/08/2011 -28/-8/11 =12days
26/12/2012 - 2/01/2013 =7days
21/04/2013 - 24/06/2013= 64days
23/08/13 - 05/11/13 = 74days
24/12/13 - 02/01/14 = 9days
02/02/2014 - 28/06/2014 = 146days
09/09/2014 - 02/01/15 = 115 days

I have tried to manipulate these dates with possible application dates so i can be below the 180days per 12 calendar months. can someone look into this for me and help me out with an advice i don't mind giving you a call and paying for your service. More over is there another number to reach the work permit.com advice line? as the number above +443449919222 never responds? is there a best time to call? cause i am calling from the USA

I will appreciate someones help pleas as this can be so frustrating

secondly is it possible to apply for an extension of tier 1 general before the deadline of april even though i am on my second round of tier 1 to complete my 5years in 2016. thanks.
