Hello ,
Can someone help me please.
I am going to apply for my wife's ILR in Mar 2015.Just read the following on UKBA website.

When you apply for settlement, you and your partner must:

be living together in your own accommodation
not be using public funds

At the moment we receive Child benefit on my name and Child tax credit and Working Tax Credit as a couple.
UKBA website clearly says you and your partner must not use public funds.
Could you please guide me on this.Do I have to stop claiming these benefits ??

Hi,

You put a question for which you already know the answer.

If your visa says no recourse to public funds that means NO TO PUBLIC FUNDS very simple......

If you look at ILR application under point 5.5 both the benefits fall under this category.

Please STOP taking benefits till your ILR is clear otherwise you will risk loosing your application falling in favour of positive outcome

Repay all the benefits and take a letter from council to this effect as you have ample time.

@Honey2008 - you are incorrect. If the OP has ILR or is British, they are claiming in the correct way.

As the OP has opened a thread in the benefits forum and I have responded, I will be locking this thread.
