Surinder Singh - entering Dublin query

Hi, we are going to move to Dublin to exercise my treaty rights for my wife to get into the UK eventually. My wife will be arriving on a NZ passport (from NZ) on her own with our baby son (British). What should she expect the immigration officer at Dublin Airport to say?

What documents must she have with her?
Are there specific documents we need to prove we plan to settle there?

She has been declined a spouse visa and overstayed for 4 months in the UK. Will they let her into Dublin ok?

No youre not :roll: we dont mention that sort of thing because it might seem you are trying to cheat the system.
The overstay should not matter because you wont be using national rules you will be using EU rules.
I would hope the immigration officer will say failte

i'm merely going to exercise my right under EU law to have my wife live with me in a member state and then obtain the correct documentation to allow my wife to live in the UK. can you explain how that is cheating the system?

Cheating, well there is a bit about not using the EEA rules to get around the National rules on immigration.

Whatever your plans :wink: dont mention that you are going to the host state in order to get into another state.

does anyone have an actual experience getting into Dublin?

my wife is a non-visa national and we won't be able to apply for an EU1 or whatever it's called as i'm currently living in scotland. our plan is for my wife to fly into Dublin and to settle there.

as my wife will not have a visa (being from NZ she doesn't need to apply for a visit visa) does she still have the rights under free movement? this seems like a bit of a grey area.

any assistance greatly appreciated.

webbynz, on the basis that you intend to exercise the Surinder Singh route.

My tuppence worth ....see if the following helps

1. You move your centre of life from the mainland UK to Ireland, live in accommodation in Ireland, start working, keep records of your life in Ireland, bills etc
2. As a kiwi she is allowed in as a visitor to Ireland without a visa
3. She has copies of your passport, marriage certificate etc
4. When she arrives in Ireland you either with her when she arrives, or are in the arrivals lounge to meet her

I think that's pretty much it
