PLEASE HELP ME.
I have been on Tier2 General for the last 4 1/2 years, i accepted a simple caution last week for stupid work related issue.
now i was supposed to apply for ILR in 6 months but after this caution i would need to wait for 24 months.
on the other hand my Tier 2 visa will not take me beyond 6 years mark, so at the end I would have about 6 months gap between the end of my Tier2 and when i m legible for ILR.
please respond and tell me what could be done.

since your initial T2G visa was granted before April 2011 the 6 year cap doesn't apply to you and you can extend your leave (with a new CoS)

Thanks Manci for your reply.
My initial Tier 2 was 06/2010 but my current visa has been issued 03/2013.
do you still think It should be alright?

I think its the initial Tier 2visa approval that you were granted that's the deciding factor. In that case you are not counted amongst those who have a cap of 6 years.

My initial tier 2 was issued in Feb-2010 , and an extension in 2012 December. My question is - am i eligible to make another extension or apply for a fresh CoS. ( I may not be eligible for PR due to a long absence during 2012)
Does the 6yrs cap affect me ?

you can extend your leave indefinitely but will need a new CoS for each extension. You don't apply for a CoS, it is assigned to you by your sponsor.

no

Thanks a lot Manci.
here's my situation - my initial T2G started feb 2010 - dec 2012 ( 3yrs ) and 1st extension ( dec 2012 - dec 2015 ) . I have two long absences ( between 2010 - 2012 ) . When my continuous period for the purpose of ILR is calculated from jun 2010 to june 2015, the absences can be adjusted within the maximum allowed absence of 180 days . ( it works out to 2 absences of 178 days each )
Given that the absence is too close to its maximum limit , I'm a bit concerned about applying for the ILR..
Should i get a fresh CoS and apply for ILR after 2 yrs or is it still worth trying to apply for ILR. Please advise..
Any thoughts on this please ?

if the absences were 180 days or less in each of the five one year periods counted backwards from the date of the application, and they were for permitted reasons, it shouldn't matter that they are close to the limit. In making the decision the caseworker is just applying the rules.
Any thoughts on this please ?
