Uk national going back plan

Post by chand1234 » Fri May 01, 2015 8:50 am

hello all.
my wife is uk national by birth and have been living in pakistan since birth.
we got married 6 years ago and have been living in Pakistan.
we have 2 kids, both kids already have uk passport obtained from pakistan by applying at pakistan.
now we plan to go to uk.
here is the plan let me know if its workable and what additional things i need to care of.
1. my wife and kids fly back to uk to her grand grand parents home and stay there.
2. on same flight i join them on visitor visa uk.
3. in uk we arrange for job for my wife that make 18600 p per anum. and she pays her taxes etc.
4. while she is at work i take care of kids at home.
5. after 6 months my visit visa expire and i return and at that point she files my spouse visa.
6. after 3 to 4 months when my spouse visa is approved i go back to uk and join them.
so how does that sound?
also.
1. is it fine for her and kids stay with grand grand parents? or for spouse visa she should have own apartment etc? note grand parents has 2 homes one is rented which they can vacate for us as well for a year.
2. along with 18600 per year requirement. when my wife apply for my spouse visa. does she need to have extra bank balance in uk? if yes how much minimum.
3. when she apply for my spouse visa. do i need to have any bank statement ? if yes how much minimum?
what else is necessary step i might be missing?
thanx in advance
beside i wish i could come earlier than them as i can easily earn 40 to 50k per anum due to my education and job expertise, experience.

Link below has a lot of the info :

https://www.gov.uk/join-family-in-uk/overview
1. my wife and kids fly back to uk to her grand grand parents home and stay there. Should be ok as long as there is no issue with overcrowding and grandmother provides accommodation proof documents.
2. on same flight i join them on visitor visa uk. This might be difficult for you to get. Spouse of BC are often refused visitor visas as they cannot prove strongly enough, their ties to their home country
3. in uk we arrange for job for my wife that make 18600 p per anum. and she pays her taxes etc. Should be fine, as long as she meets the financial requirement.
4. while she is at work i take care of kids at home. Not an issue
5. after 6 months my visit visa expire and i return and at that point she files my spouse visa. See comment at #2. You apply for the spouse visa, not your wife.
6. after 3 to 4 months when my spouse visa is approved i go back to uk and join them.Yes
so how does that sound?
also.
1. is it fine for her and kids stay with grand grand parents? or for spouse visa she should have own apartment etc? note grand parents has 2 homes one is rented which they can vacate for us as well for a year. Should be fine, see #1 above. Don't bank on a tenanted property being vacant and available to you as evicting a tenant can take a long time through the courts.
2. along with 18600 per year requirement. when my wife apply for my spouse visa. does she need to have extra bank balance in uk? if yes how much minimum. You apply, not your wife. No maintenance fund required, she only has to meet the financial income requirement.
3. when she apply for my spouse visa. do i need to have any bank statement ? if yes how much minimum? You apply not your wife. Your spouse has to meet the financial requirement.

A Section 21 notice needs to be for a minimum of two months. Great if the tenant complies, but if he does not, it can take six months to a year to get everything in place to move them out.

I think the plan for applying for a visitor visa is highly unlikely. Can the grandparents not look after their grandchildren in the UK, while the mother (your wife) works?

Agree secret.simon, this is how it should work but often does not. I know of someone who has had 4 x S21 notices and it is two years on and they are still in the property even with being through courts.

But if the grandparent has sufficient room in their property and overcrowding won't be an issue, then all should work out fine.

so i cannot get visit visa along with my wife. what other options i have?
my aunti(sister of my father and my cousins and few close friends) also lives in uk. can they send me independent visit visa to meet them?
regarding my wife grand parents taking care of child. that is bit difficult as she is widow and in not good health, also kids going to miss me :( since they are too small.
also any business visa? like i want to explore some business for my company(not my own company) but show me as marketing manager etc of some local company.? although visit visa looked easier at first.

You would need to follow the same process as any other visit visa applicant and provide evidence of strong ties to home country and your financial circumstances in home country to convince the ECO that you intend to leave the UK at the end of your 'visit'. You would also have to convince the ECO that you are a genuine visitor.

yes i have been on my current job since last 10 years. i have salary slips for that too.
Regarding Earning, i do earn approx 900 pounds/Month(if i convert) in Pakistan. and my bank account has approx 6500+ Pounds right now More will be added as i will be selling a small property soon , so it will be around 12000 pounds.

Regarding Ties, i live in my Dad House ( Dad has passed away , i do have house papers with me) My Mum Lives in Pakistan (Although she is Malaysian) ,
My 2 Kids and Wife are in Pakistan (Although they will be flying in approx 1 week difference with me to UK ) as whole plan is to take them to UK and start the process after 6 months.

any ideas?

And your employer will give you annual leave for 6 months?

You will need to convince the entry clearance officer, with documentary evidence, that you will leave the UK due to your strong ties in Pakistan. I don't see how you would do that if your wife and children will be in the UK.

Can I ask if you have travelled to the UK before, after marriage and birth of your children?

Essentially , have you ever being in possession of a UK visitors visa?

Dear CR001.
What about if i go to UK 1 week earlier , at that time my Wife and Kids will be in Pakistan. will that be a strong tie?
Regarding 6 Months Leave, i can work remotely as i am IT Engineer, so essentially i will not take leave from MY Employer but may work from home from UK during 6 months.

Dear Obie.
i have never been to UK, only once to Singapore when i was a kid. and never had a uk visitor visa before.

You are not allowed to do any type of work in the UK for any employer, even remotely, on a visitor visa.
