Dear all,

I have already posted other articles before about my situation.

Currently I have been granted ILR. I have a child of 5 months old with an overstayer. I did add the child's details to my ILR as I didnt want to complicate issues. When the child was born I was a work permit holder but has been granted ILR last week.

Please advise on how I can help the child gain legal Residence in UK.

I have been advised in the past by some forumers to appply using MN1 form but considering the fact that the mother is an overstayer, what should I do?

Please help.

The mother's status is irrelevant (kinda). Have you read the application form for registration for a minor? It asks for proof of claim to BC, which is obviously you, now that you hold ILR (and the child was born in the UK). We wouldn't have told you (in the other post) to register the child if we thought the mother's status wouldn't jeopardise things. So stop worrying....you're not the first in the situation, certainly won't be the last.

You should answer all questions correctly, the child IS a BC, and there's nothing that can stop her/him(?) from such entitlement.

However, I don't understand what you mean by "legal residence" for the child? Do you mean the child did not have any LTR granted with you under your WP?

Either way, make sure all answers are correct...DO add the mother's details...it'll help the mother in the long run and there's just no use lying about things.

Thanks for the clarification. The child was not part of my work permit because she was not born when I was initially granted the work permit.
I will go ahead and apply for the child using FORM MN1. I guess my fear was that the Home Office will found out that the mother is an overstayer and may refuse the application.
